RESOLUTION NO. R85-819
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS IN OPPOSITION OF HOUSE BILL 1330 AND SENATE BILL
897, AS THEY PERTAIN TO BII.I.POARD LEGISLATION.
WHEREAS, the citizens of Texas and the State Legislature in 1913
voted to give citizens the right of self determination through the
creation of Hcme-rule cities; and
WHEREAS, cities around the State have exercised this authority in
judicious and careful manner since being granted that authority; and
WHEREAS, cities have used this authority to respond to citizen
concerns for regulations of billboards for the health and safety of
their ccaxaunity through the passage of ordinances which establish
billboard standards and require noa-conforming billboards to be removed
after conpletionofequitable amortization; and
WHEREAS, the ability of cities to utilize amortization as a means
of billboard regulation has been upheld numerous tim~s in State aD~
Federal Court; and
WHEREAS, the billboard industry is proposing legislation which
would eliminate the use amortizatica by requiring cash payment prior to
the removal of non-conforming billboards:
NOW, THEREFORE BE IT RESOLVED by the Plainview City Council that
the proposed billboard legislation is not in the best interest of the
citizens of Texas because of the threat it poses to the doctrine of
local self-determination;
BE IT FURTHER RESOLVED, that the Legislature of the State of Texas
be ask to oppose House Bill 1330 and Senate Bill 897.
