A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS AUTHORIZING THE MAYOR TO EXECUTE AN AGPWm~T WITH
THE HALR COUNTY CONF~SIONERS COURT CALLING FOR THE CITY OF
PIAINVIEW TO FUND ONE-HALF OF THE ~Y RETAINER FEE FOR
FOR A FORENSIC PATHOLOGIST.
WHEREAS, the City of Plainview has periodic need for Forensic
Pathologist; and
WHEREAS, Hale County is charged with the responsibility of
providing a Forensic Pathologist; and
WHEREAS, the City of Plainview is a part of Hale County; and
WHEREAS, it is in the best interest of all the citizens of Hale
County and the City of Plainview that these two governmental entities
cooperate with each other:
NOW, THEREFORE BE RESOLVED by the City Council of the City of
Plainview, Texas that its Mayor is hereby authorized to execute an
agreement to pay Hale County $50.00 per month in order to offset a
portion of the monthly retainer fee required of a Forensic Pathologist.
NOW, BE IT FURTHER RESOLVED that said agreement is to have a clause
whereby it may be cancelled by either party with 30 days written notice.

AGREEMENT

THIS AGREEMENT entered into this the
,,~~ , 1985, by and between the City of Plainview, Texas,
hereinafter called CITY, and Hale County, Texas, hereinafter
called COUNTY.
WHEREAS, pursuant to Article 49.03, Texas Code of Criminal
Procedure the COUNTY is required to pay reasonable fee to the
physician making autopsy in all cases in which autopsies have
been ordered in Hale County, Texas; and,
WHEREAS, COUNTY has contracted with forensic pathologist
to provide autopsy services in Hale, County, Texas and as a part
of the consideration for the performance of autopsy services
has agreed to pay said physician a monthly retainer; and,
WHEREAS, COUNTY.has requested that the City of Plainview,
Texas assist in the payment of a portion of the expense incurred
by the County for the employment of said forensic pathologist;
and
WHEREAS, it has been determined by the City CoUncil of the
City of Plainview, Texas-that it. would be~in the best interest
all the citizens of Hale County and of the citizens of the
City of Plainview that the two (2) government entities cooperate
with each other in the employment of a forensic pathologist.
NOW THEREFORE for and in consideration of the mutual
covenants and agreements recited herein, the CITY agrees to
pay Hale County,- Texas the sum of FIFTY AND NO/100 DOLLARS
($50.00) per month to offset a portion of the monthly retainer
paid by COUNTY for the employment of a forensic pathologist.
Said payment of FIFTY AND NO/100 DOLLARS-($50.00) per
month shall be made by CITY to. the COUNTY beginning on the
first day of /~~ , 1985, and on the first day of each
succeeding month thereafter until this Agreement is terminated
by CITY or COUNTY.
CITY or COUNTY shall at its option have a right to terminate
this agreement by giving thirty (30) days written notice to the
other party as' provided herein. Upon receipt of notice from
ei~ther party, of intent to terminate this Agreement this Contract
shall become null and void and the CITY ~shall have no further
obligation to pay said FIFTY AND NO/100 DOLLARS ($50.00) to
the COUNTY beginning on the first day of the month thirty (30)
days after ntoice of intent to terminate said Agreement has been
made as provided herein.
Ail notices t.o be given hereunder shall be made in writing
and shall be addressed to the party to receive such notice and
shall deposit in the U~S. Mail'with sufficient postage attached.

The date of giving notice shall be deemed to be the date
