A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS, AUTHORIZING THE CITY MANAGER
TO NEGOTIATE WITH NEW DAWN ENERGY CONCEPTS, INC.
FOR A STREET USE PERMIT AND PAYMENT OF A GROSS
RECEIPT TAX FOR ENERGY PRODUCED AND SOLD BY NEW
DAWN ENERGY CONCEPTS, INC.
WHERERAS, New Dawn Energy Concepts, Inc. has formulated an
Agreement with Fred Garrison, a citizen of Plainview, for the
construction of a wind powered electric generator and the usage
of the energy produced thereby; and
WHEREAS, all variances for the construction of the wind
powered electric generator has been duly approved by the Board
of Adjustment; and
WHEREAS, the New Dawn Energy Concepts, Inc. has requested the
use of Right of Way owned by the City of Plainview for the transmission
of energy produced; and
WHEREAS, by Ordinance of the City of Plainview any public utility
which uses City owned Right of Way for the purpose of transmitting and
selling energy shall be subject to a gross receipt tax levied by the
City of Plainview;
NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council:
SECTION 1: To Authorize the City Manager to negotiate a street
use permit with New Dawn Energy Concepts, Inc. for the location of
transmission lines upon City owned Right of Way.
SECTION 2: To authorize the City Manager to negotiate with
New Dawn Energy Concepts, Inc. for the assessment of a gross receipt
tax in compliance with City Ordinances, if applicable.
