The Plainview City Council met on August 26, 2008 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 5:15 p.m. on August 21, 2008. Mayor John C. Anderson
presided. Councilmembers present were: Cathy Waggoner-District 2, Belinda Pena-
District 3, John N. Bertsch-District 4, and Roland Nash-District 7. Councilmember
Kelvin Tipton-District 1, Ron Truster-District 5 and Wendell Dunlap-District 6 were
absent.
Staff members present were: Greg Ingham-City Manager, Leslie Pearce-City Attorney,
John Castro-Director of Community Services, Will Mull-Police Chief, Eric Turner-Main
Street Coordinator, Kelli Shurbet-Nursing Supervisor, Dale Simpson-Director of Civil
Service and Belinda Hinojosa-City Secretary.

Councilmember Roland Nash delivered the invocation and led in the Pledge of
Allegiance.
Councilmember Pena moved to adopt the consent calendar. The motion was duly
seconded by Councilmember Waggoner and carried by unanimous vote. Items
approved on the consent calendar included approval of the minutes of August 12,
2008 and August 21, 2008; granting of excused absences to Councilmembers
Kelvin Tipton, Ron Truster and Wendell Dunlap; and approval of the financial
reports.
Mayor Anderson presented for consideration on second reading Ordinance No. 08-
3501, an Ordinance of the City Council of the City of Plainview, Texas, ("City") Adopting
the Rate Review Mechanism Tariff; Adopting a Savings Clause; Determining that this
Ordinance was Passed in Accordance with the Requirements of the Texas Open
Meetings Act; Declaring an Effective Date; and Requiring Delivery of this Ordinance to
the Company and Legal Counsel. Since this was the second of two readings, the
Council chose to forego the staff briefing and asked for public comment. There was no
public comment.
Councilmember Pena moved to approve Ordinance No. 08-3501 on second reading.
The motion was duly seconded by Councilmember Nash and carried by unanimous
vote.
Kelli Shurbet, Nursing Supervisor presented for consideration to authorize Mayor to sign
Contract No. 2009-028861 between the Department of State Health Services and
the Plainview-Hale County Health District for immunization services for children and
adults. She stated this is annual contract in the amount of $92,068 which is a 5%
increase over last year's amount. This is for immunization services for adults and
children.
Mayor Anderson asked for public comment. There was no public comment.

Councilmember Nash moved to authorize Mayor to sign Contract No. 2009-028861
between the Department of State Health Services and the Plainview-Hale County
Health District. The motion was duly seconded by Councilmember Bertsch.
Councilmember Bertsch asked what the dates of the Contract were. He was advised
the Contract is for the period from September 1, 2008 through August 31, 2009.
Mayor Anderson asked for a vote on the matter. The motion carried unanimously.
Mayor Anderson moved to go into closed session to deliberate the appointment,
employment, evaluation, reassignment, duties, discipline or dismissal of a public officer
or employee, or to hear a complaint or charge against an officer or employee. (fex.
Gov't. Code, Section 551.074] Appointments to the following boards and
commissions: Airport Board and Main Street Program/Tourism Coordinating
Board. The motion was duly seconded by Councilmember Pena and carried by
unanimous vote.
Mayor Anderson recessed the meeting at 7:09 p.m.
Mayor Anderson called the meeting back to order at 7:35 p.m.
He moved to appoint John M. Tye to the Airport Board to complete the unexpired term
vacated by Randy Reed with said term to expire on January 2009 and to reappoint Bill
Cross to the Airport Board with said term to expire on January 2012. The motion was
duly seconded by Councilmember Nash and carried by unanimous vote.
There being no further business, Mayor Anderson adjourned the meeting at 7:38 p.m.
