HomeMy WebLinkAbout08 0923 min243 The Plainview City Council met on September 23, 2008 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 4:15 p.m. on September 19, 2008. Mayor John C. Anderson presided. Councilmembers present were: Kelvin Tipton-District 1, Cathy Waggoner- District 2, Belinda Pena-District 3, John N. Bertsch-District 4, Wendell Dunlap-District 6 and Roland Nash-District 7. Councilmember Ron Trusler-District 5 was absent. Staff members present were: Greg Ingham-City Manager, Mike Gilliland-Director of Public Works, Leslie Pearce-City Attorney, John Castro-Director of Community Services, Will Mull-Police Chief, Eric Turner-Main Street Coordinator, Jack Keller- Budget Manager, Dale Simpson-Director of Civil Service and Belinda Hinojosa-City Secretary. News Media Representative: Tommy Young-Plainview Daily Herald Mayor John C. Anderson delivered the invocation and led in the Pledge of Allegiance. Councilmember Dunlap moved to adopt the consent calendar. The motion was duly seconded by Councilmember Waggoner and carried by unanimous vote. Items approved on the consent calendar included approval of the minutes of September 9, 2008 and September 18, 2008; granting of an excused absence to Councilmember Ron Trusler and approval of financial reports. Greg Ingham, City Manager presented for consideration upon second reading Ordinance No. 08-3502, an Ordinance adopting and approving the Budget for the Fiscal Year beginning October 1, 2008, and terminating September 30, 2009, and making such appropriations for each department, project and account; severability clause; cumulativeness clause; conflicts clause; effective date. He stated this is the final reading of the budget. The total budgeted expenditures for fiscal year 2008-2009 which includes the Special Revenue Funds, Debt Service Fund and Dedicated Improvement Funds is $22,893,760. The budgeted revenues for the major operating funds for fiscal year ending September 30, 2009 is $19,719,415 and the budgeted expenditures for the major operating funds and debt service is $19,632,068. The General Fund revenues are $10,995,315 which includes $4,096,000 for property tax; $3,275,000 for sales tax, $1,699,075 for franchise tax and $150,000 for interest. The General Fund Expenditures are $10,957,280 of which $2,875,015 is for Fire/EMS/Civil Service and $3,078,655 is for Police. The total of expenditures for fire and police total approximately $6 million which is more than the proposed property tax revenue of approximately $4 million. The proposed tax rate is $0.5685 per $100 valuation. The Solid Waste Management Fund revenues for fiscal year ending September 30, 2009 are $2,844,000 and the Solid Waste Management Fund Expenditures are $2,824,565 for operating costs plus $815,000 in system improvements for a total of $3,639,565 in expenditures. A 5% increase in refuse charges is included in this Fund. The Water and Sewer Fund Revenues are $5,890,300 and the expenditures are $5,069,075, plus debt service of $781,460 and system improvements of $561,000 for a total of $6,411,535. In order to fund these departments, a 5% increase in water and sewer charges have been included. City Council Minutes September 23, 2008 Page 1 of 4 244 He presented a summary of the combined impact of fee and tax increases on an average homestead using typical water consumption. Atypical winter charge for water at 6,000 gallons is currently $19.96 with a proposed charge of $20.99. The typical winter charge for sewer at 6,000 gallons is currently $16.65 with a proposed charge of $17.47. The typical winter charge for garbage is $16.48 with a proposed cost of $17.30. The total single family residential at 6,000 gallons is currently $53.09 and the proposed cost is $55.76 for a combined monthly increase of $2.67. An average home valued at $74,280 at the current rate of $0.5342 is $396.80. The proposed tax rate at $0.5685 would see the cost at $422.28 for an annual increase of $25.48 or $2.12 a month with a combined cost of $4.79. Mayor Anderson asked for public comment. Dwane McGuire of 1114 Kokomo expressed concern regarding the tax increase and mentioned.. the County's ability to lower the tax rate. He offered the suggestion to purchase supplies from smaller companies in order to save money. He expressed discontent~with all the districts and the amount of graffiti. Councilmember Nash moved to approve Ordinance No. 08-3502 on second reading. The motion was duly seconded by Councilmember, Tipton and carried by unanimous vote. Mr. Ingham presented for consideration an action to ratify the Property Tax Increase Reflected in the FY 2008-2009 Budget. He stated this is part of the Truth in Taxation requirements to make sure that the Council is aware of the tax increase reflected in the budget with a tax rate of $.5685 per $100 valuation. Mayor Anderson asked for public comment. There was no public comment. Mayor Anderson moved to ratify the property tax increase reflected in the FY 2008-2009 budget that being a rate of $.5685 per $100 valuation. The motion was duly seconded by Councilmember Bertsch and carried by unanimous vote. Mr. Ingham presented for consideration on second reading Ordinance No. 08-3503, an Ordinance levying Municipal Ad Valorem Taxes for the City of Plainview, Texas, for the year 2008, and directing the assessment and collection thereof; severability clause; cumulativeness clause; conflicts clause; and effective date. He stated the proposed tax rate for Fiscal Year 2008-2009 is $0.5685. The rollback rate for 2008-2009 is $0.5742, the adopted tax rate for 2007-2008 is $0.5342 and the effective tax rate for 2008-2009 is $0.5216. Mayor Anderson asked for public comment. There was no public comment. Councilmember Pena moved the adoption of a tax rate of $0.5685 per $100 valuation. The motion was duly seconded by Councilmember Bertsch and carried by unanimous vote. Mr. Ingham presented for consideration on second reading Ordinance No. 08-3504, an Ordinance of the City of Plainview, amending Chapter 25 Article II, Section 25.41 entitled "Water Rates, billings" of the Code of the City of Plainview, Texas; City Council Minutes September 23, 2008 Page 2 of 4 cumulativeness clause; conflicts clause; severability clause; and effective date. These 245 proposed rate changes were addressed earlier and since no one had a question Mayor Anderson asked for public comment. There was no public comment. Councilmember Waggoner moved to approve Ordinance No. 08-3504 on second reading. The motion was duly seconded by Councilmember Dunlap and carried by unanimous vote. Mr. Ingham presented for consideration on second reading Ordinance No. 08-3505, an Ordinance of the City of Plainview, amending Section 25-42, entitled "Monthly Sewer Rates" of the Code of the City of Plainview, Texas; severability clause; cumulativeness clause; conflicts clause; effective date. These proposed rate changes were addressed earlier and since no one had a question Mayor Anderson asked for public comment. There was no public comment. Councilmember Nash moved to approve Ordinance No. 08-3505 on second reading. The motion was duly seconded by Councilmember Waggoner and carried by unanimous vote. Mr. Ingham presented for consideration on second reading Ordinance No. 08-3506, an Ordinance of the City of Plainview, Texas, amending Section 22-32 entitled "Refuse Collection Fees; Water Termination" of the Code of Ordinances of the City of Plainview, Texas; severability clause; cumulativeness clause; conflicts clause; effective date. These proposed rate changes were addressed earlier and since no one had a question Mayor Anderson asked for public comment. There was no public comment. Councilmember Tipton moved to approve on second reading Ordinance No. 08-3506. The motion was duly seconded by Councilmember Dunlap and carried by unanimous vote. Mr. Ingham presented for consideration on second reading Ordinance No. 08-3507, an Ordinance of the City of Plainview amending Ordinance No. 07-3485 to appropriate funds in the General Fund and various revenue and capital funds pursuant to Section 5.07 (a) of the Plainview City Charter allowing for supplemental appropriations in the 2007-2008 budget; cumulativeness clause; conflicts clause; severability clause; and effective date. Since this was the second of two readings, the Council chose to forego the staff briefing and asked for public comment. There was no public comment. Councilmember Dunlap moved to approve Ordinance No. 08-3507 on second reading. The motion was duly seconded by Councilmember Pena and carried by unanimous vote. Greg Ingham, City Manager presented for consideration to authorize Mayor to sign Texas Department of Transportation Grant for Routine Airport Maintenance Program, TxDOT Project No. AM 2009PLNVW. This is for the RAMP (Routine Airport Maintenance Program). This is a 50/50 grant. The contract is for $12,940 and the City and County's portion is $6,470 with the City's portion being $3,235. It also includes the AWOS (automated weather observation system). Mayor Anderson asked for public comment. There was no public comment. Councilmember Bertsch moved to authorize Mayor to sign Texas Department of Transportation Grant for Routine Airport Maintenance Program. The motion was duly seconded by Councilmember Waggoner and carried by unanimous vote.
