R79-175 O0 067 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS EXEMPTING VARIOUS PARTIES FROM THE FEDERAL PROHIBITION AGAINST OUTDOOR GAS LIGHTING. WHEREAS, Section 402 of the Federal Power Plant and Industrial Fuel Use Act of 1978 (P.L. 95-620), certain standards prohibiting the certain use of natural gas for decorative outdoor lighting in the United States; and WHEREAS, the Governor of the State of Texas has designated each duly incorporated municipality within the State of Texas to grant exemptions to the users of natural gas for outdoor lighting when doing so would be in public interest and consistent with the purpose of said act; and WHEREAS, by doing such the City Council of the City of Plainview, Texas does not desire, nor intend to become an enforcement agency and interfere with the rights of the citizens of the City of Plainview to use natural gas for lighting purposes; and WHEREAS, the~parties indicated below have filed an application for exemptions with the City Clerk of the City of Plainview and have stated reasons for exemptions that are either in the public interest or consistent with the purpose of said act: NOW, THEREFORE BE IT RESOLVED BY the Mayor and the City Council .of the City of Plainview, Texas to grant exemptions from the federal prohibitions against outdoor lighting (Section 402, Power Plant & Industrial Use Acto of 1978, (P.L. 95-620) to the following parties: Wayland Baptist College, 1900 West 7th Hale County Court House, 500 Broadway Wood-Dunning Funeral Home, 2615 W. 6th First Christian Church, 910 Kokomo Plains Medical Clinic, 715 Amarillo Broadway Gas Light Project, 830 Broadway Pioneer Natural Gas Company, 2007 N. Columbia Pioneer Natural Gas Company, 113 W. 8th PASSED AND APPROVED this the 13th day of November, 1979. ATTEST:
