A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, DECLARING THE INTENT TO ACQUIRE CERTAIN PARCELS IN
CONJUNCTION WITH THE 1978-80 COMMUNITY DEVELOPMENT STORM
DRAINAGE PROJECT.
WHEREAS, the engineering consultants and the surveying consultants
have determined the appropriate location for the portion of the proposed
east drainage channel between East 3rd Street and East 9th Street; and
WHEREAS, the City Engineer has determined that there is an immediate
need to acquire that portion of the channel right-of-way, in order that,
construction may proceed in conjunction with the City of Plainview's 1979
Paving Project; and
WHEREAS, the acquisition of the storm drainage channel right-of-way
will eventually help alleviate the storm water runoff problem on the east
side of the City:
NOW, THEREFORE BE IT RESOLVED by the Mayor and the City Council of the
City of Plainview, Texas, to authorize the acquisition of the storm drainage
channel right-of-way between East 3rd and East 9th streets described as
follows: '

*Since these tra~ts are located in a flood hazard area the acquisition
of the strom drainage channel right-of-way may leave the owner with an
uneconomic remnant. If the appraisal indicates the leaving of an un-
economic remnant the City must, in accordance with Section 301.(9) of
the Uniform Relocation Assistance and Real Property Acquisition Policies
Act of 1970 (.P.L~ 91-646), offer to purchase the entire property. The
legal description of the tracts identified by asterisks (w), therefore,
may need to be adjusted to reflect the acquisition of the entire lot.
