R80-2IS 00 120 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS ACCEPTING THE RESIGNATION OF MEDLIN CARPENTER, COUI~ILMAN, PLACE TWO, TO BECOME EFFECTIVE MARCH 26, 1980. WHEREAS, Medlin Carpenter presently holds position as Council member, Place Two on City Council, Plainview, Texas, and has more than one year remaining in his present term of office; and WHEREAS, Medlin Carpenter has filed and made public of hiT desire to seek the elected position of Mayor for the City of Plainview; and WHEREAS, Medlin Carpenter does n~t__wiSh to cause .adJilio~t.financial expense on the City of Plainview by requiring a special election to fill ~h unexpired term of Place Two, should he be elected Mayor of the City of Plainview: NOW, THEREFORE BE IT RESOLVED BY THE Mayor and the City C~uncil of the City of Plainview, Texas that the resignation of Medlin Carpenter, . Councilman Place Two, be received and accepted to become effective March 26, 1980. PASSED AND APPROVED this the 26th day of February, 1980. BOX 520 PLAINVIEW, TEXAS February 21, 1980 Mr. John Hatchel City Manager City of Plainview Plainview, Texas Dear John: The Texas State Constitution, says that if an individual has more than one year to serve and he announces for another election office, he automatically resigns from the first office. A case filed recently in the Federal Court in E1 Paso, which ruled that a person can hold one office and be a candidate for another. However, my philosophy of government is in accord with belief that one does not hold one office and run for another. Also, the cost to the City for holding a special election in case I become Mayor would be unnecessary and extravagant. Therefore, I submit my resignation for Councilman, Place Two, to become effective on Wednesday, March 26, 1980.
