R80-267 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,TEXAS AUTHORIZING A STREET USE PERMIT FOR A BRICK RETAINING WALL FROM 1001 to 1007 JEFFERSON STREET. WHEREAS, Lon C. Cartwright has filed a request with the Plainview City Council to be granted a STreet Use Permit for a brick retaining wall and plater box located from 1001 to 1007 Jefferson Street; and WHEREAS, Section 28-8 of the Plainview City Code makes unlawful for any person to construct, reconstruct, alter or repair any fence, wall, hedge:, structure or any other character of a struction over, on, or between the property line of any lot and a public street subject to the following conditions: Section~ 1: Section 2: Section 3: Be it known to Lon Cartwright that the City of PlainView has a 14 inch water main in the public right-of-way which would be covered by this structure and if for any reason the City desires or needs to gain access to that water main or fuse the land for any other public purpose, the City of Plainview is in no way be responsible or liable for damages incurred to the brick wall or planter box placed on public right£ of-way. No retainer wall or planter box shall exceed height of eight (8) inches above the curb line. Lon C. Cartwright will immediate put into effect and furnish the City Secretary a certificate of insurance, with an insurance company authorized to do business in the State of Texas in the amount, not less than $300,000 as protection to the City of Plainview for any liability which might be incurred as results of this structure being placed on public right-of-way. The above named requirements has to be accomplished or put into effect within 30 days of the passing of this resolution or th6 Street Use Permit will be declared void with penalties outlined in Section 28-8 of the Plainview City Code being enforced and allother legal remedies available to the City of Plainview shall be enforced.
