R80-294 O0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS AUTHORIZING THE BIAYOR TO ENTER INTO AN AGREEMENT BETWEEN THE CITY OF PLAINltlEW AND JAMES AND DORIS ADAMS WAIVING THE PAVING ESCROW REQUIREMENTS FOR PROPORTY ABUTTIN FM 400 SUBJECT TO SPECIFIED CONDITIONS. WHEREAS, the City Council of the City of Plainview by their taken on May 27, 1980, approved the preliminary plat of Bryan Addition, unit No. 8 property being owned by James Doris Adams; and WHEREAS, by previous by the City Council in passes of Ordinance- No. 78-22S9 dated November 14, 1978, Mr. Adams would be required to deposit with the City of Plainview the cost of installing a'cUrb and gutter on State Farm to Market Road 400 along the portion of Bryan Addition, Unit No. 8, which abuts the highway; and WHEREAS, there is no project proposed by the State Highway Department or the City for the construction of curbs and gutters on the State Farm- to,Market Road 400 at this time creating no necessity at this for the payment of cost of the installation of the curb and gutter: NOW, THEREFORE BE IT RESOLVED BY the Mayor and City Council of the City of Plainview, Texas that the Mayor be authorized to enter into an Agreement betweeen the City of Plainview, and games ~ Doris Adams, granting a variance :to~%he~.requirements for establishing escrow account upon the following Conditions: 1) Mr. Adams agrees that in the event at a future date it should be determined by the City or the Texas Highway Department that a necessity exists for the construction of the curb and gutter on that portion of State Farm-to-Market Road 400 which abutts said Bryan Addition, Unit No. 8, Mr. Adams will pay to the City that cost of construction of said curb and gutter. 2) Mr. Adams agrees that in the event he shall subdivide Byran Addition, Unit No. 8, he shall pay to the City the cost of__const~ucting curb and gutter along that portion of State Farm-to-Market Road 400 which abutts said Bryan Addition, Unit No. 8 at the time that said property is subdivided. 5)~Mr. Adams agrees that in the event he shall sale any or all of the property located in Bryan Addition, No.8 he shall at that time of:.said conveyance, pay to the City the cost of constructing curb and gutter along that portion of State Farm- to-Market Road 400 which abutts said Bryan Addition, Unit No. 8.
