RESOLUTION NO. R80-295
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS AMENDING RESOLUTION NO. R80-288
BY GRANTING A VARIANCE TO THE SET BACK REQUIRE-
MENTS OF THE SUBDIVISION REGULATIONS ON THE
PRELIMINARY PLAT OF GIBSON'S ADDITION, UNIT NO. 1.
WHEREAS, the Preliminary Plat of Gibson's Addition Unit No. 1
was approved subject to compliance with the set back requirements
of the Subdivision Regulations by Resolution No. R80-288; and
WHEREAS, a request has been made for a variance to the afore-
mentioned requirement; and
WHEREAS, the Planning & Zoning Commission recommends that the
City Council grant a variance to the set back requirements of the
Subdivision Regulations and maintain the set back requirements of the
Zoning Ordinance, for the following reasons:
1) This being an isolated case in that most properties
surrounding it are platted and therefore, are permitted
to use the setback requirements of the Zoning Ordinance.
The fact that this property is changing ownership and
is required by Subdivision Regulations to be platted,
subjects this property to the Subdivision setback require-
ments.
2) Since all construction that now exist on properties to the
East, West, and North of this property have been permitted
to build according.to the Zoning Ordinance setback requirements,
it would be unfair for Mr. Blankenship to require him to set
back further than was required of adjoining property owners.
3) Permitting this request would not be granting a special
privilege to an individual; and would not affect the surrounding
properties as they now exist.
NOW, THEREFORE BE IT RESOLVED BY THE Mayor and City Council of
the City of Plainview, Texas to amend Resolution No'. R80-288 by granting
a variance to the set back requirements of the subdivision regulations
on the Preliminary Plat of Gibson's Addition, Unit No. 1.
