R81-S8S A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT PRO- VIDING FOR THE PAYMENT OF ATTORNEY'S FEES TO THE CITY ATTORNEY FOR THE COLLECTION OF DELINQUENT AD VALOREM TAXES OWED TO THE CITY OF PLAINVIEW. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS: SECTION 1: The City Council of the City of Plainview finds that certain individuals and entities have failed to discharge their ad valorem tax obligations owed to the City of Plainview whereby it is necessary that judicial remedies be sought to enforce the collection of these delinquent taxes. SECTION 2: The City Council of the City of Plainview further finds that the number df suits now pending in the District Court of Hale County, Texas, and those contemplated are so numerous that additional compensation should be awarded to the City Attorney for his efforts mn this behalf. SECTION 3: The City Council of the City of Plainview finds that $~5~0-0~ each suit filed in Court plus fifteen per cent (15%) of all amounts collected as a result of litigation should be awarded to the City Attorney in this behalf. SECTION 4: The City Council of the City of Plainview hereby authorizes the Mayor to enter into an agreement with the City Attorney providing for additional compensation as provided in Section 3 hereof. AGREEMENT THIS AGREEMENT is entered'into this Sth day of May, 1981, b'y and between the CITY OF PLAINVIEW, TEXA~, hereinafter called "City", and TOM HAMILTON, hereinafter called "City Attorney"; WHEREAS, the City Council of the City of Plainview finds that certain individuals and entities have failed to discharge their ad valorem tax obligation owed to the City whereby it is necessary that judicial remedies be Sought to enforce t~e collection of these delinquent taxes; WHEREAS, the City Council of the City of Plainview further finds that the number of suits now pending in a District Court and other Courts of Hale County, Texas, and thoSe contemplated, are so numerous that additional compensation should be awarded to the City Attorney for his efforts in this behalf; The parties hereby enter into the following Agregment: It is agreed by and between the parties that the-City shall pay to the City Attorney the sum of $25.00 for each suit filed in Court for the purpose of collecting delinquent ad valorem taxes plus the sum of fifteen (15%) per cent of all amounts collected as a result of such litigation. II. It is further agreed between the parties that the City Attorney shall bill the City for his services in this behalf at such times as shall be mutually convenient between the parties. Any and all. other agreements between the parties regarding the compensation to the City Attorney for the collection of delinquent ad valorem taxes ~ are hereby superceded and repealed by the terms of .this Agreement.. This Agreement shall be retroactive and effective from April 28, 1981. WITNESS OUR HANDS this the day and year first above written. CITY OF PLAINVIEW
