Plainview City Hall, 901 Broadway. The Council met in pre-session at 6:30 p.m. The agenda for
this meeting was posted in City Hall at 4:30 p.m. on December 5, 2000, with an addendum posted
at 1:45 p.m. on December 6, 2000. Mayor Lloyd C Woods presided. Councilmembers present
were: Sam Parker-District 1; Mary Jane Shanes-District 2; Rey Rosas-District 3; Mike
Hutcherson-District 4; Ross Owen-District 5; Bobby R. McGehee-District 6; and Irene Favila-
District 7.

Staff members present were: James P. Jeffers-City Manager; Wally Hatch-City Attorney; John
Castro-Director of Community Development; John Berry-Director of Public Works; Norman
Huggins-Director of Finance; Gary Glass-Fire Chef, and Will Mull-Chief of Police.
News media present were: Richard Orr-Plainview Daily Herald.
There were no guests present.
Councilmember Owen delivered the invocation.
The Girl Scouts led in the Pledge of Allegiance.
Mayor Woods moved that the Consent Calendar be approved as presented. Councilmember
Hutcherson duly seconded the motion, which carried by unanimous vote. The Consent Calendar
consisted of the following items: Minutes of November 23 and November 28, 2000, were
approved; receipt of departmental reports; approval of expenditures; appointment of Michael
Black, Kemp Hinch, Bernie Vering, and Phyllis Wall to the Human Relations Commission, with
said terms of office expiring on January 1, 2003; awarding of the $87,719 bid (which fell within
3% of the local bid preference limit) for four (4) ~A-ton pick-ups with utility bodies to Jack
Morris Ford; awarding of the $20,620 low bid for one (1) 4-wheel drive / 4-door sport utility
vehicle to Crown Dodge of Houston and accepting their noted exceptions; awarding of the $29,750
bid (which fell within 3% of the local bid preference limit) for two (2) ~A-ton short-wide pickups,
one a V-6 and the other a V-8, to Gardner Chevrolet; and awarding of the $14,555 low bid for one
(1) mid-sized car for Municipal Court to Capital Chevrolet of Austin.
Ericka Jathan, RN, Nursing Supervisor of the Plainview / Hale County Health Department,
provided the department's annual report.
Mayor Woods requested a motion to go into closed session for consultation with attorney pursuant
to § 551.071 of the Texas Open Meetings Act regarding pending or contemplated litigation,
specifically, Kinnikin and Moore contemplated litigation involving the wastewater treatment
plant. Councilmember Owen made said motion, which was duly seconded by Councilmember
Rosas and carried by unanimous vote. Mayor Woods moved the Council into closed session at
7:15 p.m.
The Council reconvened in open session at 7:37 p.m. Councilmember Rosas moved that the
meeting be adjourned. The motion was duly seconded by Councilmember Shanes and carried by
unanimous vote. There being no further business, Mayor Woods adjourned the meeting at 7:38

The Plainview City Council met on December 21, 2000, at 11:30 a.m. at the Plainview
Convention Center, 2902 West 4th Street, Plainview, Texas. The agenda for the meeting was
posted in City Hall at 11:00 a.m. on December 18, 2000. Mayor Pro Tem Bobby R. McGehee
presided. Councilmembers present were: Mike Hutcherson-District 4 and Ross Owen-District 5.
Councilmembers absent were: Lloyd C. Woods-Mayor; Sam Parker-District 1; Mary Jane
Shanes-District 2; Rey Rosas-District 3; and Irene Favila-District 7. As there was not a quorum
present, no action was taken on any agenda item.
Staff members present were: Norman Huggins-Director of Finance; Wally Hatch-City Attorney;
Will Mull-Chief of Police; John Castro-Director of Community Development; John Berry-Director
of Public Works; Dale Simpson-Director of Civil Service; Matthew Tsakanikas-Main Street
Coordinator; Rusty Powers-Fire Lieutenant; and Christina Bonner-Deputy City Secretary.
There were no news media representatives present.
Guests present were: Ron Trusler-MH/MR Director and Raby Garrett.

There were no City Council reports.
Lee C. Coffey, Sunshine Jackson Coffey, L J. (Jack) Jackson, and Elsie Lee Lynch have requested
a variance from platting requirements. The Coffey Tract is located outside of the City limits but
falls within Plainview's extraterritorial jurisdiction. City Ordinance requires that anything under
five (5) acres be platted. The Coffey Tract is a three-acre tract of land out of the J. H. Bryan
Homestead Survey. Said area does not have a masterplan. If platted, the Coffeys would have to
provide for an alley and street John Berry advised that there is no need for an alley in that area at
this time. If a variance were granted, the City would still be able to control future development.
The Planning and Zoning Commission has recommended granting of the variance. No action on
this agenda item was taken due to lack of a quorum.
The Council discussed holding a public hearing regarding the Local Law Enforcement Block
Grant for fiscal year 2000. The hearing would determine whether or not the City is interested in
pursuing the grant. The potential grant from the U. S. Department of Justice would total $11,876,
with the City contributing $1,485. Said grant cannot be used to supplant or replace local funds, but
it can be used in a number of different categories. If awarded, the City would probably apply grant
funds to three or four different areas. No action on this agenda item was taken due to lack of a
Second reading of Ordinance No. 00-3275 authorizing the condemnation of private property to be
used for the purpose of a permanent utility easement; severability clause; cumulativeness clause;
conflicts clause; and effective date. The property at issue is Lots 18 and 19, Clear View Acres
Subdivision, Plainview, Hale County, Texas, owned by Weldon Henry (2200 Block of East 5th
Street). No action on this agenda item was taken due to lack of a quorum.
Pursuant to {}551.071 of the Texas Open Meetings Act regarding pending or contemplated
litigation, Mayor Pro Tem McGehee moved the Council into closed session at 12:00 p.m. for
consultation with the City Attorney regarding the condemnation of a parcel of land situated in the
City of Plainview and being particularly described as a 4.72 acre tract out of Section 16, Block D6,
Hale County, Texas, owned by Bobby Kernell (2103 East 5th Street). The COuncil reconvened in
open session at 12:35 p.m. No action was taken on this agenda item due to lack of a quorum.
