A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS DECLARING A 92.8 ft. x 182.2 ft.
TRACT OUT OF SECTION 40, BLOCK JK-2 SURPLUS REAL
PROPERTY; AUTHORIZING THE ADVERTISEMENT FOR BIDS;
PROVIDING FOR PAYMENT OF SAID ADVERTISEMENT; AND
PROVIDING FOR THE RETAINING OF A DRAINAGE EASEMENT
ACROSS SAID PROPERTY.
WHEREAS, the First United Methodist Church is interested in
acquiring a 92.8 ft. x 182.2 ft. tract containing 0.39 acres out of
Section 40, Block JK-2 to construct a gymnasium which is legally
described as follows:
BEGINNING at a point 282.2 feet West of the Southwest corner of
Block 80, Alexander-Westmoreland Addition, to the City of Plainview,
Hale County, Texas,
Thence West, 92.8 feet to a point at the intersection of the
North line of West 6th Street and the East line of Houston Street,
to a point;
Thence North, 182.2 feet toa point;
Thence East, 92.8 feet to a point;
Thence South, 182.2 feet to the point of beginning and
containing 0.39 acres; and
WHEREAS, Ordinance 65~859 requires the advertisement for
sealed bids before conveyan~e~of~ '-~surplus real property; and
WHEREAS, under normal conditions the advertisement for
sealed bids is initiated by an interested buyer, therefore, the
successful bidder should be willing'to pay the cost of the advertise-
ment; and
WHEREAS, the City of Plainview needs to retain excess to a
Storm Water Drainage Pipe which crosses the southwest corner of said
tract, which necessitates the retaining of an easement legally
described, as follows:
BEGINNING at a point 310.0 feet West of the Southwest corner
of Block 80, Alexander-Westmoreland~Addition, to the City of Plainview,
Hale County, Texas;
Thence West 65 feet to a point at the intersection of the
North line of West 6th Street and the East line of Houston Street;
Thence North 50 feet to a point;
Thence East 50 feet to a point;

Thence Southeasterly 52.2 feet to the PLACE OF BEGINNING:
NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of
the City of Plainview, Texas to:
SECTION 1:
Declare as surplus real property a 92.8 ft. x 182~2
ft. tract containing 0.39 acres out of Section 40,
Block JK-2, Plainview, Hale County, Texas.
SECTION 2: Authorize the City Manager to advertiae for
sealed bids.
SECTION 3:
Instruct the City Manager to insure payment of
the advertisement by the successful bidder and
to retain the drainage easement legally described
above.
