HomeMy WebLinkAbout09 0210 min275 The Plainview City Council met on February 10, 2009 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 3:45 p.m. on February 6, 2009. Mayor John C. Anderson presided. Councilmembers present were: Kelvin Tipton-District 1, Cathy Waggoner- District 2, Belinda Pena-District 3, Ron Trusler-District 5, Wendell Dunlap-District 6 and Roland Nash-District 7. Councilmember John N. Bertsch-District 4 was absent. Staff members present were: Greg Ingham-City Manager, Mike Gilliland-Director of Public Works, Leslie Pearce-City Attorney, Will Mull-Police Chief, Dale Simpson- Director of Civil Service, Rusty Powers-Fire Chief, Delwin Derrick-Code Enforcement Officer, Eric Turner-Main Street Coordinator and Belinda Hinojosa-City Secretary. Councilmember Roland Nash delivered the invocation and led in the Pledge of Allegiance. Councilmember Dunlap moved to adopt the consent calendar. The motion was duly seconded by Councilmember Pena and carried by unanimous vote. Items approved on the consent calendar included the granting of an excused absence to Councilmember John N. Bertsch, ratifying the Mayor's reappointment of Joel Steed and Jorge Sanchez to the Plainview Housing Authority with said terms to expire on January 1, 2011; and the appointment of Ron Roberts to the Building Trades/Fire Code Board of Appeals with said term to expire on January 1, 2013. Mike Gilliland, Director of Public Works presented for consideration to award bids and authorize Mayor to execute necessary agreements for purchase of backhoe. Three bids were received as follows: Heritage Equipment with a base bid price of $77,300.00 with $18,000.00 for trade-in for a total price of $59,300.00; Warren CAT with a base bid price of $69,425.00 with $13,000.00 for trade-in for a total price of $56,425.00 and Yellowhouse Machinery with a base bid price of $75,985.00 with $15,000.00 for trade-in for a total price of $60,985.00. The parks department has a backhoe that is not working. It has been estimated that it will cost $6,500 to fix the backhoe belonging to the water department. It is his recommendation that the City keep the backhoe belonging to the water department and turn it over to the parks department. This would have the City being over budget $5,725.00. However the City was under budget in the amount of $3,269.00 with a recent pick-up purchase. This would just put us over budget in the amount of $2,456.00. Also, the parks department backhoe will be presented at auction for sale and this would help with the budget shortfall. The last backhoe sold at auction sold for $8,600. Mayor Anderson asked for public comment. There was no public comment. Councilmember Trusler moved to award the bid to Warren CAT for $69,425.00. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. Mayor Anderson moved to go into closed session to deliberate the purchase, exchange, lease or value of real property in accordance with Tex. Gov't Code, Section 551.072. and to consult with attorney on pending or contemplated litigation or settlement of same in accordance with Tex. Gov't Code, Section 551.071. (Police Department). The motion City Council Minutes February 10, 2009 Page 1 of 2 276 was duly seconded by Councilmember Trusler and carried by unanimous vote. Mayor Anderson recessed the meeting at 7:09 p.m. Mayor Anderson called the meeting back in open session at 8:05 p.m. Councilmember Kelvin Tipton moved to approve Ordinance No. 09-3511, an Ordinance Authorizing the Transfer of Lot 3, Block 1, Country Club Addition, an Addition to the City of Plainview, Hale County, Texas to Plainview Habitat For Humanity, Incorporated, in Accordance with Section 253.011 and Section 272.001 of the Texas Local Government Code; and Authorizing the Mayor to Execute all Documents Necessary to Transfer Ownership; the Transfer of This Property is Not Subject to the Notice, Bidding, and Obtaining Fair Market Value Requirements of State Law. The motion was duly seconded by Councilmember Waggoner. Mayor Anderson asked for public comment. There was no public comment. Mayor Anderson, Councilmembers Tipton, Waggoner, Trusler, Dunlap and Nash voted "for" the motion. Councilmember Pena abstained from voting on the matter. The motion carried. Mayor Anderson announced that no action would be taken on the item regarding pending or contemplated litigation or settlement of same.
