R88-142 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS AUTHORIZING THE MAYOR TO EXECUTE A MEMORANDUM AND AGREEMENT FOR LEGAL SERVICES WITH TOM HAMILTON. WHEREAS, Tom Hamilton has provided many years of valuable service to the City as its City Attorney; and WHEREAS, the City desires to retain the services of Tom Hamilton for advice and counsel on matters pending, and future as Tom Hamilton is acutely aware of City affairs; and W~F-REAS, a Memorandum and Agreement for legal services is attached and hereby made a permanent part of this Resolution. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview, Texas that the Mayor is authorized to execute the attached Memorandum and Agreement for legal services with Tom Hamilton, an Attorney At Law of Hale County, Texas having his principal office and place of business in the City of Plainview. Ridlehuber, Mayor ATTEST: Carla J.(~Reese, City Secretary APPROVED AS TO CONTENT: David Alan Blackburn, City Attorney STATE OF TEXAS S ~ MEMORANDLR~ANDAGREEMENT COUNTY OF HALE ~ FOR LEGAL SERVICES This Agreement, entered into this the ~x of ,z~/, , 1988, by and between the City of Plainvie~, a Texas Municipal Corporation 'in the County of Hale, referred to hereinafter as "City" and Tom Hamilton, an Attorney at Law of Hale County, Texas having his principal office and place of business in the City of Plainview, hereinafter referred to as "Attorney". WHEREAS, Attorney has provided many years of valuable service to the City as its City Attorney; and WHEREAS, City desires to retain the services of Attorney for advise and counsel on matters pending and future as Attorney is acutely aware of City affairs; NOW, TtfEREFORE, WITNESSETH: ARTICLE I. City agrees to pay Attorney as compensation for his services at the rate of $90~'00 per hour for legal services rendered on behalf of the City. Compensation is to be paid by City upon monthly statements rendered by Attorney to City. ARTICLE II. This Agreement shall be for a term of three (3)~ years· 074 ARTICLE III. Attorney agrees to act in accord with the wishes of City and to work with the offices of the City Attorney on such legal services as needed. Attorney agrees not to assume any duties and responsibilities that would prejudice Attorney's ability to faithfully execute his duties and responsibilities to the City. ARTICLE IV. Any previous agreements executed by the parties concerning legal services is hereby revoked. This instrumen~ contains the entire Agreement between the parties relating to th~ rights herein granted on the obligations herein assumed. Any oral representations or revocation concerning this instrument shall be of no force and effect, excepting modification in writing, signed by both parties.
