SUBDIVISION REGULATIONS - BUILDING PERMIT - HORNE
RESOLUTION NO. R88-184
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS, GRANTING ISSUANCE OF A BUILDING
PERMIT IN ACCORDANCE WITH SECTION 6 OF THE PLAINVIEW
ZONING ORDINANCE ON TEMPORARILY ZONED PROPERTY AND
GRANTING A VARIANCE FROM THE SUBDIVISION ORDINANCE BY
ALLOWING THE ISSUANCE OF THE SAID PERMIT FOR THE
CONSTRUCTION OF A RESIDENCE ON NEWLY ANNEXED PROPERTY
LOCATED ON WESTRIDGE ROAD PRIOR TO THE COMPLETION OF
THE ZONING AND PLATTING PROCESS.
WHEREAS, R.E.~ Horne, Jr., has petitioned the City Council of the
City of Plainview to annex property owned by him which is adjacent to
the City of Plainview and described by the attached metes and bounds
description; and
WHEREAS, the City Council of the City of Plainview has
conducted a public hearing and approved annexation of the said tract
of property; and
WHEREAS, it is the desire of R.E., Horne, Jr., to complete the
required zoning and platting processes necessary to make the property
conform with City regulations; and
WHEREAS, R.E. Horne, Jr., desires to cOntinue construction on
the residence he is proposing to erect on this said tract; and
W/~EREAS, Section 6 of the Plainview Zoning Ordinance No. 82-2478
permits a building permit to be issued by the City Council of the
City of Plainview on any temporarily zoned newly annexed property;
and
WHEREAS, the subdivision regulations of the City of Plainview
also known as Ordinance No. 78-2259, requires all subdivisions or
platting of the property be completed prior to issuance of a building
permit; and
WHEREAS, a variance from the subdivision regulations would be
needed to continue construction on the residence prior to completion
of the platting process; and
WHEREAS, the Planning and Zoning Commission of the City of
Plainview has reviewed the building permit as required by Ordinance
and recommended that a building permit be issued subject to Mr.
Horne's agreement to comply with all other regulations of the
Subdivision Ordinance as well as all other City code requirements
effecting the said tract of land.

NOW, T~EREFORE, BE IT RESOLVED by the City Council of the City
of Plainview, Texas in accordance with Section 12 of Ordinance No.
78-2259 as amended, wherein the Planning and Zoning Commission may
grant a variance to the regulations imposed by the Ordinance and
Section 6-1(c) of Zoning Ordinance No. 82-2478 which' allows the City
Council upon recommendation of the Planning and Zoning Commission to
issue a building permit, to authorize 'the issuance of a building
permit for the erection of a residence on the said tract of land
owned by R.E. Horne, Jr., and located on Westridge Road. This
authorization to issue a building permit is not a waiver of any
requirements but is to permit the issuance of the building permit
prior to completion of all requirements set forth by the Zoning
Ordinance, Subdivision Regulations, and other applicable codes of the
City of Plainview.

Block JK-2, Hale County, Texas, described by metes and
bounds as follows:
BEGINNING 2621.2 feet North and 37.5 feet East of the
Southwest (SW) Corner of Section 28, Block JK-2;
THENCE North 95 feet to a-3/8 inch ~teel rod;
THENCE Southeasterly 151.58 feet around a curve to the
right having a radius of 600 feet a central.angle of 14
deg. 28.5' and a chord bearing S. 82 deg. 45.75' E.
151.20 feet to a 3/8 inch steel rod;
THENCE South 75.92 feet to a point 5 feet NOrth of a 3/8
inch steel rod;
THENCE West 150.0 feet to the PLACE OF BEGINNING.
