R88-210 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, NOMINATING AN AREA, AS A JOINT APPLICANT WITH HALE COUNTY, AS AN ENTERPRISE ZONE PURSUANT TO THE TEXAS ENTERPRISE ZONE ACT; PROVIDING TAX INCENTIVES; PROVIDING OTHER INDUCEMENTS; AND DESIGNATING A LIAISON TO ACT AS THE CITY'S AUTHORIZED REPRESENTATIVE IN ALL MATTERS PERTAINING TO THE CITY AND COUNTY NOMINATION OF AN AREA AS AN ENTERPRISE ZONE AND TO ITS DESIGNATION AS SUCH BY THE TEXAS DEPARTMENT OF COMMERCE. WHEREAS, the City Council of the City of Plainview, Texas desires to create the proper economic and social environment to. induce the investment of private resources in productive business enterprises located in severely distressed areas of the City and County and to provide employment to residents of such area; and W~F. REAS, certain conditions exist in such area which represent a threat to the health, safety and welfare of the people of such areas; and WHEREAS, it is necessary and in the best interest of the City to nominate such area as an enterprise zone pursuant to the Texas Enterprise Zone Act; and WHEREAS, the area nominated is more fully described in Exhibit A, which is hereto attached and made a permanent part of this Resolution. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview, Texas: That the City hereby nominates, in conjunction with Hale County, the area set forth in Exhibit A of this Resolution. 2. That the City Council finds qualifications of the act. the zone area meets the That the City Council, in conjunction with Hale County and the Plainview Independent School District, will provide certain incentives applicable to business enterprises in the zones which are not applicable throughout the City as described in Exhibit B which is attached hereto and made a permanent part of this Resolution. e That the area described in this Resolution is designated as an Enterprise Zone, subject to the approval of the Texas Department of Commerce. 1 of 2 193 That the City Council directs and designates the City Manager of the City of Plainview to act as the City's authorized representative to act in all matters pertaining to the nomination and designation of the area described herein as an enterprise zone. e The City Council designates the Plainview/Hale County Industrial Foundation as the lead economic development Agency and- the President of the Foundation as the liaison to administer the Enterprise Zone Program. That a public hearing to consider this Resolution was held pursuant to the terms of this Act on November 22, 1988. The Mayor is hereby authorized to execute an agreement with the Plainview Independent School District, Hale County, the Plainview/Hale County Industrial Foundation, the Plainview Chamber of Commerce, and any other interested entities in relation to the Enterprise Program. TAX ABATE~RNT. RESOLUTION NO. R88-210 ENTERPRISE ZONE INCENTIVES 194 Tax Abatement may be provided in accordance with the "City of Plainview Policy Statement for Tax Abatement" as adopted on November 22, 1988, and as may be amended. (See "Exhibit C") 2. TAX INCREMENT FINANCING (TIF) A plan of action will be developed to permit Tax Increment Financing for on-site and off-site improvements. Realizing that governmental entities cannot accomplish redevelopment by themselves, this cooperative effort would enable business expansion and revitalize the "distressed" area using an infusion of private monies. In keeping with the traditional methods of TIF, the additional tax funds generated by the development would be used to retire the TIF Bond purchased by investors. TIF may require forfeiture of all or part of the businesses' tax abatement. 3. ~RISE PROJECTS Participating entities and organizations will encourage qualified businesses in the Enterprise Zone to apply for designation as an Enterprise Project. Each proposal must demonstrate that the business is experiencing economic distress and has a strategy to achieve economic revitalization. 1 of 6 19,5 4. BUILDING PERMIT FEES, SUBDIVISION FEES, ZONING FEES AND ALARM ORDINANCE FEES Any request for fee reduction shall be reviewed by the City Manager. The City Manager will make recommendations to the City Council regarding whether the reductions should be offered in each individual case. The recommendation shall be based upon a subjective evaluation of the following criteria which each applicant will be requested to address in narrative format: EMPLOYMENT IMPACT: How many jobs will be brought to Plainview?; What types of jobs will be created?; What will the total annual payroll be? FISCAL IMPACT: How much real and personal property value will be added to the tax rolls?; How much direct sales tax will be generated?; How will this project affect existing business and/or office facilities?; What infrastructure construction would be required?; What is the total annual operating budget of this facility projected to be? COMMUNITY IMPACT: What affect would the project have on the local housing market?; What environmental impact, if any, will be created by the project?; How compatible is the project with the City's Comprehensive Plan? The preceding subjective criteria will be used by the City Manager in determining whether or not it is in the best interest of the City of Plainview to recommend that fee reductions be offered to a particular applicant. Specific considerations will include the degree to which the individual project furthers the goals and objectives of the City, as well as the relative impact of the project. Any person, organization, or corporation desiring that Plainview consider providing fee reduction to encourage location or expansion of operations within the City limits of Plainview shall be required to comply with the following procedural guidelines. Nothing within these guidelines shall imply or suggest that Plainview is under any obligation to provide fee reduction in any amount or Value to any applicant. PRELIMINARY APPLICATION STEPS Applicant shall complete "Application for Fee Reduction" as prescribed by the City Manager's Office. Applicant shall address all criteria questions outlined previously. 3 of 6 197 Applicant shall prepare a plat showing the precise location of the property, construction specifications, all roadways within 500 feet of the site, and all existing land uses and zoning within 500 feet of the site. De If the property is described by metes and bounds, a complete legal description shall be provided. Ee Applicant shall complete all forms and information detailed in items A thru D and submit them to the City Manager, City of Plainview, 901 Broadway, Plainview, Texas 79072. APPLICATION REVIEW STEPS Ail information in the application package detailed above will be reviewed for completeness and accuracy. Additional information may be requested as needed. The application will be distributed to the appropriate City Departments for internal review and comment. Additional information may be requested as needed. Copies of the complete application package and staff comments will be provided to the Mayor and City Council. 4 of 6 CONSIDERATION OF THE APPLICATION The City Council will consider the application at a regular or called meeting(s). Additional information may be requested as needed. Jo The City Council of Plainview may hold a public hearing and determine whether the project is "feasible and practical". K. The City Council of Plainview may consider adoption of a Resolution calling for the fee reduction. 5. SALE OF LAND The City of Plainview may sale City owned land, within the Enterprise Zone, for less than market value. The City Council will review each piece of City owned property within the Zone and the City Council alone will determine the terms and conditions for which land may be sold below market value. 6. Lease/Purchase arrangements are negotiable to perspective businesses and to businesses desiring to expand within the zone, and the City Council shall be the final authority on these matters. 7. These inducements may be amended periodically by the Plainview City Council. 6 of 6 NOTICE OF PUBLIC HEARING ON CITY/COUNTY ENTERPRISE ZONE PROGRAM The Plainview City Council will conduct a Public Hearing -6~ Plainview's Proposed Enterprise Zone Program at 7:30 p.m., Tuesday, November 22, 1988, in the City Council Chambers, 901 Broadway, Plainview, Texas. Enterprise Zones are statistically defined areas characterized by high unemployment and poverty levels. The Proposed Enterprise Zone Program consist of 1980 Census Tract 9901 Block Groups 1, 2, 3, and 4. Census Tract 9902 Block Groups 1 and 3. Census Tract 9903 Block Groups 3 and 4. Enumeration Districts 2004 and 2005. The Proposed Program would provide incentives such as tax abatements, tax increment financing, low interest loans and other inducements designed at locating or expanding business/industry in the Enterprise Zone. All interested persons including residents of the proposed zones, are encouraged to present their views at the Hearing. The Plainview City Council may authorize an application for State designation of these zones following the Hearing.
