R88-225 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE A MEMORANDUM OF UNDERSTANDING ON BEHALF OF THE PLAINVIEW/HALE COUNTY HEALTH DISTRICT, WITH THE SOUTH PLAINS COMMUNITY ACTION ASSOCIATION FOR THE PROVIDING OF FAMILY PLANNING SERVICES IN PLAINVIEW AND HALE COUNTY. ~hereas, the City of Plainview and Hale County have created the Plainview/Hale County Health District in order to provide various services to the citizens of Plainview and Hale County; and Whereas, the Health District has provided Family Planning Services through the South Plains Community Action Association for several years; and Whereas, a copy of the proposed contract between the Health District and the South Plains Community Action Association for the providing of Family Planning Services is attached and hereby made a permanent part of this Resolution; and Whereas, the Health District Board has recommended the approval of said contract. Now, Therefore, Be It Resolved by the City Council of the City of Plainview, Texas, that the Mayor is hereby authorized to execute a contract on behalf of the Plainview/Hale County Health District, with the South Plains Community Action Association for the providing of Family Planning Services in Plainview and Hale County. Ridlehuber, Mayor Carla Reese, City Secretary /ames P.~=Teffers/C~~ APPROVED AS TO FORM: '~rney 226 Memorandum of Understanding between Plainview-Hale County Health District and South Plains Community Action Association for the provision of Family Planning Services in Hale County The.purpose of this Memorandum of Understanding between South Plains Community Action Association (SPCAA) and the Plainview-Hale County Health District (PHCHD) is to delineate the responsibilities of the two entities in order to provide family planning services to women in need in Hale county. The Texas Department .of Health (Title X)-and the Texas Department of Human Services (Title XX and XIX) funds Family Planning services through a fourteen county grant/contract with SPCAA'who subcontracts with PHCHD for these services in Hale County. As Title X/XX funding has been reduced to SPCAA'and as more concrete performance criteria are being applied to SPCAA for the use of this money, especially -in the area of recruitment and service to teens', it has become necessary for SPCAA to formalize its long standing working relationship with the PHCHD. The following represents a mutual agreement as to how family planning services wiI1 be funded and provided in Hale county as well as a definition of the role the new nurse practitioner who shall begin work in Hale county in January, 1989. 1. SPCAA's funding to the Plainview-Hale County Health District will be limited to the salaries of the nurse practitioner and the two clinic aides inclusive of fringe benefits, trave!~ and merit raises, and malpractice in- surance for the nurse practitioner. Appropriate continuing education oppor- tunities will be funded and/or provided by SPCAA as the need arises. 2~ SPCAA will also fund five (5) physician clinics per month in Hale County between the dates of January l, 1989 and March 31, 1989 in order to increase physician supervision of the graduate nurse practitioner during the first three months of her preceptorship. Thetotal number of physicians involved in staffing these clinics, inclusive of the PHCHD Medical Director, shall not exceed three (3) in order to provide consistent medical supervision and guidance to the-graduate nurse practitioner. Beginning April 1, 1989 SPCAA will fund one (1) physician sts~f£e.dclinic per month in Hale county to address family planning or women's health related problems identified by the nurse practitioner during routine family planning clinics which were beyond her scope of practice. Physician reimbursement methodology and scheduling of physicians is the responsibility of the administrator of the PHCHD, however SPCAA reimbursement per clinic shall not exceed $150.00. 3. No other reimbursement for.on-site physician nor lab services will be made effective January 1, 1989. 4'. SPCAA will fund referrals to a certified OB/GYN specialist for abnormal pap smear results reported as moderate or severe dysplasia or cancer in situ. Referrals should be made within 30 days of receipt of the abnormal pap re- suits. Funding will be based on current Medicaid rates and will be limited to the initial consultation and or colposcopy. All pathology, laboratory, and subsequent physician services/hospitalizations are the responsibility of the patient. Referrals may be made to local gynecologists who are willing to accept SPCAA's reimbursement policy and who are agreeable ~o work with patients needing hospitaiization or other treatments to secure these services within Hale county. THE PHCHD administrator is responsible for all arrangements reIated to local referrals. 5. The number of family planning clinics offered in Hale County will be ex- panded to eight per month. This will include at least two night clinics (commencing at 4:30 p.m. or later) in Plainview 'whose priority clients will be teens and the working poor. Two clinics a month will be held in Hale Center in facilitiesrfurnished by~SPCAA. When clinic expansion is complete, no more than two. weeks shall elapse between.clinics provided at the same time and place in order to facilitate outreach activities. This expansion-of clinics shall commence no later than February 1, 1989 and be completed no later than April 1, 1989. All new clinics shall initially offer at .least 3 hours of appointments~for annual exams, physical exams for follow-up purposes, etc. and be expanded as needed~to meet the patient demand. It is estimated that an established, full-time clinic will span six hours with appointments scheduled (inclusive of a "no show" factor)'so that 20-25 women are examined and counseled per clinic. 6. Community Action Agency techniques and personnel will be utilized as needed for outreach to fill the expanded clinic~schedule. PHCHD will be expected to fully cooperate with all outreach personnel and plans. All coor- dination of outreach plans and/or resolution of outreach .problems shall be between the Administrator of the PHCHD and the Executive Director of Caprock Community Action and/or his designated staff supervisor. Outreach activities shall be consistent with the program goals and objectives of the Title X and Title XX Family Planning programs including the targeting of teens and low income women who are at high risk to be added to the state's Medicaid and/or Aid for Dependent Children's programs 'if an unplanned pregnancy shoUld occur. 7. PHCHD will be expected to comply with all Title X and XX grant/contract guidelines for services provided. This shall include contract services mon- itoring visits by TDHS/Title XX, Participation in the Quality Assurance program mandated by Title X, and adopting the Title XX/SPCAA Fee Schedule as PHCHD's Fee Schedule~for all Family Planning Services. No PHCHD family planning patient who is covered by this memorandum may be charged fees not listed on the most recent revision Of the attached to this memorandum as Appendix A. Problems with adherence to Title XX/X program guidelines identified by either the TDHS contract services monitor or SPCAA Director of Health Services Shall be cor~ rected within 15 days of PHCHD's receipt of documentation of the problem. 8. Only SPCAA's Family Planning Sliding Fee Scale shall be used for Family Planning patients up to 250% of poverty per Title X/XX guidelines. SPCAA will continue to bill and receive payment for all Title X, XX, and XIX (Medicaid) patients. ~All billing for client charges shall be done by the SPCAA billing office in Leveltand. Client co-payments collected at the time service is rendered may be used by the PHCHD. No client may be denied ser- vices for lack of payment. 9. All women receiving family planning services provided by the PHCHD shall be treated with dignity, respeet, privacy, and confidentiality. This shall include that no woman shall be asked to undress, dress, nor wait partially clothed in any area other than her examination room. 10. PHCHD will continue to provide pharmaceuticals, laboratory services, nursing support, clerical support, and facilities in Plainview. Per Title X guidelines laboratory services for urine Pregnancy tests must be done on- site. Supply refill clinics may be scheduled for times other than formal Family Planning clinics az the discretion for the PHCHD administrator. 228 ~Appendix A lists those lab and pharmacy services PHCHD is expected to provide vs those SPCAA will reimburse. 11. Beginning in January through June, 1989, the new nurse practitioner shall be relieved of her duties in the PHCHD on Thursdays to attend her preceptorship Clinics at the Texas Tech University Health Sciences Center in Lubbock. 12. Beginning on January 3, 1989, the new nurse practitioner shall be assigned to the Floydada Clinic on Tuesdays. Medical supervision, clerical and nursing support for the Floydada clinic shall be the responsibility of SPCAA. 13. Upon successful completion of her preceptorship, the nurse practitioner shall'assign approximately 60% of her time to Family Planning and 40% of her time to other PHCHD activities. Family~Planning time shall include provision of family planning Clinics in Hale and Floyd counties, public speaking to civic and school groups upon request concerning teen pregnancy and other family planning issues, preparation time for~the preceding activities, periodic SPCAA Staff / Quality Assurance COmmittee meetings, and continuing education activities related to family planning. Other activities which may arise and would legitimately be related to the family planning program could be informally negotiated between the SPCAA Director of Health Services and the Administrator of the PHCHD. 14. The nurse practitioner assigned to. the PHCHD shall function under medical protocols based upon theTitle X/XX pPogram guidelines and augmented by protocols developed with thePHCHD Medical Director. The PHCHD Medical Director shall serve as her clinical supervisor and shall review and co-sign all of her charts for clinics conducted in Hale CoUnty.* 15. Within the conditions set forth in this contract, the PHCHD Administrator/ Nursing Supervisor Shall be responsible for the scheduling of all Family Planning Clinics in Hale County and the supervision and scheduling of SPCAA employees assigned to the PHCHD. Personnel policies of the PHCHD shall supercede those of SPCAA in all personnel-administration matters except employee compensation which has previously been agreed upon between the nurse practitioner and SPCAA. The PHCHD Administrator shall be responsible for employee evaluations as necessitated by PHCHD policies and/or required by the nurse practitioner pro- gram or Title X/XX. The Plainview-Hale County Health District Medical Director shall not furnish any Supervisory Services contemplated by this Contract except for Clinics conducted solely in Hale County.
