RESOLUTION NO. R89-192
A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS AUTHORIZING THE DIRECTOR OF PUBLIC
SAFETY TO ENTER INTO A FELONY FORFEITURE AGREEMENT
WITH THE DISTRICT ATTORNEY'S OFFICE.
WHEREAS, the 1987 State Legislature has enacted a new law, in
the form of House Bill 65, which allows the proceeds from the
sale of contraband seized by law enforcement officials to be
shared by and between the state's attorney and the seizing law
enforcement agency; and
W~RREAS, H.B. 65 requires that a local agreement be entered
into between the state's attorney and the seizing law enforcement
agency in order to realize the benefits afforded under the law;
and
WHEREAS, a copy of the Mutual Agreement is attached hereto;
and
WHEREAS, the City Council finds the Agreement to be in the
best interests of the City of Plainview.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and the City
Council of the City of Plainview that the Director of Public
Safety is hereby authorized to enter into a Mutual Agreement with
the District Attorney's Office on behalf of the City of Plainview
in order to obtain the benefits afforded under state law.
