RESOLUTION NO. R89-208
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS, AUTHORIZING T~HE MAYOR TO
EXECUTE A PROMISSORY NOTE WITH PLAINVIEW
CHRISTIAN ACADEMY FOR STREET IMPROVEMENTS.
WHEREAS, the City of Plainview in conjunction with the Plainview
Independent School District made street improvements in and around
the LaMesa School including improvements on Ennis and S.W. 5th
Streets; and
WHEREAS, the City and School entered an agreement on May 4,
1988, with the U.S. Small Business Administration calling for the
U. S. Small Business Administration to reimburse the City of
Plainview and Plainview Independent School District for improvements
to Ennis and S.W. 5th Streets, adjacent to the 5.718 acres out of
NE/4, Section 29, Block JK-2, Plainview, Hale County, Texas; and
WHEREAS, said improvements cost $23,051; and
WHEREAS, the paving project was approved and accepted by the
City thru Resolution R89-175, on August 22, 1989; and
WHEREAS, the contract to secure payment for street improvements
between the SBA, City and School District called for the City to be
reimbursed thirty days from the date the improvements were herein
completed and accepted by the City thru a Resolution; and
WHEREAS, the property was sold by the U.S. Small Business
Administration to the Plainview Christian Academy on May 4, 1989;
and
WHEREAS, the Plainview Christian Academy has requested that the
City refinance the obligation; and
WHEREAS, the Plainview Independent School District has declined
to participate in the refinancing because of legal problems; and
WHEREAS, the City of Plainview feels that it is in the best
interest of the citizenry of Plainview that said refinancing be
completed so that the Plainview Christian Academy may remain a
viable operation within the Community.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Plainview, Texas, that the Mayor is hereby authorized to execute
a promissory note from Plainview Christian Academy refinancing the
$23,051 owed so that it will be paid back over a five year period at
eight percent interest.
