RESOLUTION R09-199
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS, APPROVING THE REQUEST OF BAR-
NONE RODEO ASSOCIATION AND TITAN SPORTS TO HOST
THE 2009 ANNUAL BAR-NONE RODEO AND JUNETEENTH
PARADE; AUTHORIZING THE FILING OF THE AGREEMENT
FOR THE TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY
WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR
THIS ANNUAL PARADE; DECLARING THAT THE EVENT
SERVES A PUBLIC PURPOSE; AND AGREEING TO COMPLY
WITH REGULATIONS .
WHEREAS, the Texas Department of Transportation owns and operates
U. S. Highway 70 in the corporate limits of the City of Plainview; and
WHEREAS, the U. S. Highway 70 crosses Broadway Street within the
corporate limits of the City of Plainview; and
WHEREAS, the intersection of U.S. Highway 70 and Broadway Street is
the critical vein for parade use;
WHEREAS, the City of Plainview has received a request from the
Plainview Bar-None Rodeo Association to host the 65th Annual Rodeo Parade
on June 20, 2009; and
WHEREAS, the City of Plainview has received a request from Titan
Sports, a private enterprise located in Plainview, Texas, to host the Juneteenth
Annual Parade in conjunction with the Plainview Bar-None Rodeo Parade; and
WHEREAS, the City Council of the City of Plainview finds that such
parade serves a public purpose in that the parade recognizes these two historic
events; and
WHEREAS, the City Council of the City of Plainview, Texas finds it in the
best interest for the citizens of Plainview that the annual Juneteenth Parade and
Bar-None Rodeo Parade be held this year on June 20, 2009 and use the
traditional parade route on Broadway Street, which originates at Santa Fe Depot
(Broadway at 12th Street), and goes south, crossing U.S. Highway 70, and
concludes at Third Street; and
WHEREAS, the Texas Department of Transportation requires the Local
Government to submit a completed Agreement for the Temporary Closure of
State Right of Way for use of U.S. Highway 70 in such public events as a parade;
and

WHEREAS, the City Council designates Mayor John C. Anderson as the
City's authorized official. The authorized official is given the power to apply for
or terminate such Agreement on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLAINVIEW THAT:
The request from Plainview Bar-None Rodeo Association and Titan Sports
to host the 65th Annual Rodeo Parade and annual Juneteenth Parade
(collectively called the "Parade") for June 20, 2009 is hereby approved.
II.
The public purpose of the parade is to recognize this historic event.
Submission of the completed AGREEMENT FOR THE TEMPORARY
CLOSURE OF STATE RIGHT-OF-WAY with the Texas Department of
Transportation is hereby approved.
IV.
The Mayor is hereby authorized and directed to execute, respectively, on
behalf of the City of Plainview, all necessary documents, including the
AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY,
to complete the parade preparation process.
