HomeMy WebLinkAboutR09-206 297 RESOLUTION R09 -206 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, APPROVING THE REQUEST OF THE PLAINVIEW DAILY HERALD; AUTHORIZING THE FILING OF THE AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE COWBOY DAY'S ANNUAL PARADE AND "HALE ON WHEELS" BICYCLE RIDE; DECLARING THAT THE EVENTS SERVE A PUBLIC PURPOSE; AND AGREEING TO COMPLY WITH REGULATIONS. WHEREAS, the Texas Department of Transportation owns and operates U. S. Highway 70, Business Loop 1 -27, Spur 445, Southwest 4 and FM 400 in the corporate limits of the City of Plainview; and WHEREAS, the U. S. Highway 70 crosses Broadway Street within the corporate limits of the City of Plainview; and WHEREAS, the intersection of U.S. Highway 70 and Broadway Street is the critical vein for parade use; and WHEREAS, the "Hale on Wheels" Bicycle Ride will follow a route on the following State owned and operated streets: down Business Loop 1 -27 and Spur 445, ride from Broadway onto S.W. 4 and down S.W. 4 to FM 400, and then travel down FM 400 to Bryan Street in the corporate limits of the City of Plainview; and WHEREAS, the City of Plainview has received a request from the Plainview Daily Herald on July 11, 2009; and WHEREAS, the City Council of the City of Plainview finds that such parade and bike ride serve a public purpose in that the parade celebrates Hale County's heritage; and WHEREAS, the City Council of the City of Plainview, Texas finds it in the best interest for the citizens of Plainview that the Annual Cowboy Day's Celebration be held this year on September 19, 2009 and use the above stated parade route and bike ride; and WHEREAS, the Texas Department of Transportation requires the Local Government to submit a completed Agreement for the Temporary Closure of State Right of Way for use of U.S. Highway 70, Business Loop 1 -27 and Spur 445, S.W. 4th, and FM 400 in such public events as a parade and bike ride; and WHEREAS, the City Council designates Mayor John C. Anderson as the City's authorized official. The authorized official is given the power to apply for or terminate such Agreement on behalf of the City. Resolution R09 -206 Cowboy Days Page 1 of 2 298 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW THAT: I. The request from Plainview Daily Herald to host the Eleventh Annual Cowboy Day's Celebration for September 19, 2009 is hereby approved. II. The public purpose of the parade and bike ride is to celebrate Hale County's heritage. III. Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY with the Texas Department of Transportation is hereby approved. IV. The Mayor is hereby authorized and directed to execute, respectively, on behalf of the City of Plainview, all necessary documents, including the AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY, to complete the parade and bike ride preparation process.
