HomeMy WebLinkAbout01-329380 AMENDMENT TO THE SUBDIVISION ORDINANCE ORDINANCE NO. 01-3293 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING SECTION 2, DEFINITIONS AND SECTION 6, GENERAL PROVISIONS, OF THE PLAINVlEW SUBDIVISION ORDINANCE NO. 89- 2807; STREET DESCRIPTIONS; SEVERABILITY CLAUSE; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has reviewed the Subdivision Ordinance for clarity; and WHEREAS, THE Planning and Zoning Commission has made its recommendation which was received by the City Council; and WHEREAS, from time to time it is advisable to review the Zoning Ordinance and update uses; and WHEREAS, it is found to be in the best interests of the City of Plainview to amend the following section. NOW, THEREFORE, the City of Plainview hereby ordains that: SECTION I. The following paragraphs of Section 2, Definitions, are amended to add, as follows: 2.08 Arterial streets and highways shall mean streets used primarily for fast or heavy traffic as designated in the Major Thoroughfare Plan. (Maior Thorou.qhfares) 2.09 Collector streets shall mean those streets which carry traffic from minor streets to major system of arterial streets and highways, including the principal entrance streets of a residential development or business park and those streets for circulation within such a development as designated on the Major Thoroughfare Plan (when available and as may be identified by the City. (Secondary Thorou.qhfares) 2.10 Minor streets shall mean those streets which are used primarily for access to abutting properties. (Local Thorou.qhfares) 2.11 Marginal access streets shall mean those minor streets which are parallel to and adjacent to arterial streets and highways and which provide Ordinance No. 01-3293 Amendment to Subdivision Ordinance Page 1 of 3 81 access to abutting properties and protection from through traffic. (Access or Service Roads) SECTION II. Paragraph 7, Section 6, Topography, is amended to add as follows: 7. Street Widths "Street Right-of-way Width" shall be measured from front lot line to front lot line of opposite lots. "Street Paving Width" shall be measured from outside to outside of pavement or curb lines. a. Access or Service Roads Access or Service roads shall have a minimum right-of-way width of forty (40) feet. (Marginal Access Streets) b. Local Thoroughfares Local residential streets shall have a minimum right-of-way width of sixty (60) feet unless otherwise specifically permitted by the Planning and Zoning Commission and the City Council. Local streets in apartment, commercial or industrial areas shall have a minimum R.O.W. width of seventy-five (75) feet. (Minor Streets) c. Secondary Thoroughfares Secondary or feeder streets shall have a minimum fight-of-way width of seventy-five (75) feet (Collector Streets) d. Major Thoroughfares The width of major streets shall be determined by the Planning and Zoning Commission, the City Council, the Major Thoroughfare Plan, and adopted standards. Major streets with a right-of-way width of less than one hundred' (100) feet are to be increased to a width of one hundred (100) feet for a distance of one hundred fifty (150) feet at the approach to a major street intersection, with a transition back to normal right-of-way width over a distance of an additional one hundred fifty (150) feet. (Arterial Streets and Major Hi_ahwavs) Ordinance No. 01-3293 Amendment to Subdivision Ordinance Page 2 of 3 8:2¸ SECTION III If any section, subsection, sentence, clause, phrase, or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining provisions thereof. SECTION IV. Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating, or governing the subject matter herein. SECTION V. All ordinances or portion of any ordinance of the City of Plainview, Texas, in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION VI. This ordinance shall be of full force and effect upon its passage. Passed and Approved on first reading this 10th day of July, 2001. Passed and Approved on second reading this 24th day of July, 2001.
