HomeMy WebLinkAbout01-3296114 ORDINANCE NO. 01-3296 AN ORDINANCE AUTHORIZING CITY ADMINISTRATION TO WAIVE WATER TAP UTILITY AND PERMIT FEES AT THE DIRECTION OF THE CITY MANAGER FOR NON PROFIT ORGANIZATIONS PROMOTING AFFORDABLE HOUSING. WHEREAS, the legislature has provided for the creation of programs and the making of loans and grants of public money for the public purposes of development and diversification of the economy; and, WHEREAS, the governing body of a municipality may pursuant to this legislative action establish and provide for the administration of one or more programs, including programs for making loans and grants of public money and providing personnel and services of the municipality, to promote state or local economic development; and, WHEREAS, the City Council of the City of Plainview, Texas desires to promote the economic development through development or redevelopment of affordable housing in its jurisdiction by the assisting non profit organizations in the construction of affordable housing; NOW THEREFORE, THE CITY OF PLAINVIEW HEREBY ORDAINS THAT: Section 1. That the facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct. Section 2. That the City Council does hereby authorize: a) The City Manager, after appropriate application to the Department of Community Development, may waive water tap fees and permit fees for non profit organizations that construct or rehabilitate affordable housing. b) The City Manager may waive utility usage fees for non-profit organizations that construct or rehabilitate affordable housing for six (6) months during construction or rehabilitation. Section 3. That if any section, paragraph, clause or provision of this Ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause, or provision shall not affect any of the remaining provisions of this Ordinance. Section 4. That it is hereby found, determined and declared that a sufficient notice of the date, hour, place and subject of the meeting of the City Council at which this Ordinance was adopted was posted at a place convenient and readily Ordinance No. 01-3296 Habitat for Humanity Ordinance Page 1 of 2 accessible at all times as required by the Open Meetings Law, Tex. Govt. Code Ann. § 551.001 et. seq., as amended. Section $. That this ordinance shall take effect immediately from and after its passage by the City Council. Passed and Approved on first reading this 24th day of July, 2001. Passed and Approved on second reading this 14th day of August, 2001.
