RESOLUTION - R92-112
A RESOLUTION OF THE CITY COUNCIL OF PLAINVIE~,
TEXAS, AUTHORIZING THE .MAYOR TO EXECUTE AN
AGREEMENT WITH THE WESTRIDGE WATER COMPANY,
CAIJ.ING FOR THE TRANSFER OF THOSE ASSETS TO
THE CITY OF PLAINVIE~, AND ESTABLISHING
CONDITIONS OF THE TRANSFER.
WHEREAS, the City of PlainView, Texas (herein called "the City") and
Westridge Water Company (herein called "Water Company"), desire to enter
into an agreement; and
WHEREAS, Water Company is the owner of certain properties, more fully
described in the attached agreement; and
WHEREAS, the property described in the attached agreement, is located
within the extraterritorial jurisdiction of the City, but is not contiguous to
the City; and
WHEREAS, Water Company desires to have its real property annexed to and
made a part of the territorial limits of the City and believes it can obtain the
consent and petition of the owners of:at least fifty per cent of the land in
the Westridge Addition and a majority of the qualified voters of the Westridge
Addition, including owners of property that is adjacent both to the City and
to the Water Company's property described in the attached contract, to
initiate and agree to the annexation of the entire Westridge Addition,
provided that the service plan.~as required by V.T.C.A., Local Government
Code, Sec. 43.056, and as set fOrth herein as approved by the City; and
WHEREAS, the City desires to. annex the entire Westridge Addition, and
additionally, to acquire ownership of the'water well, water storage tank, and
water delivery system, lines, pipes, etc., presently located throughout the
Westridge Addition; and
WHEREAS, Water Company is agreeable to transferring ownership of the
property described in the attached contract to the City upon the terms and
provisions of this agreement and service plan set forth herein; and
WHEREAS, the attached contract is-hereby made. a per~auent part of this
Resolution.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Plainview,
Texas, that the Mayor is hereby authorized to execute the attached agreement
on behalf of the City of Plainview.
