HomeMy WebLinkAboutR92-123RESOLUTION NO. 92-123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW AUTHORIZING A VARIANCE TO ORDINANCE NO. 89-2807, SUBDIVISION REGULATIONS. WHI~RF. AS, Ralph Miller desires to operate a driving range on a 22.46 acre tract out of the Northeast part of the remainder of a 145.86 acre tract out of the Southeast part of Survey 33, Block JK-2, Hale County, Texas, also known as 111 Quincy Street; and WHERF~S, a request came before the Planning and Zoning Commission to grant a-variance to Ordinance No. 89-2807, Subdivision Regulations; and WHEREAS, the Planning and Zoning COmmission unanimously passed the motion to grant said variance; and WHEREAS, the above-mentioned property is in a flood plain and has limited development potential; and WHEREAS, the City Council of the City of Plainview believes it to be in the best interest of the citizens of Plainview to grant said variance under certain conditions; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW that a variance be granted to Ordinance No. 89-2807 for the sole purpose of operating a golf driving range on the above-described property under the following conditions: 1. Only buildings and improvements directly related to the maintenance and operation of the driving range will be allowed; and 2. Any and all construction on the property will meet flood plain guidelines; and 3. Any construction directlY or indirectly related to water, sewage, or street maintenance and/or the connection of the property to City of Plainview water and/or sewer mains shall be done in conformance to the City of Plainview ordinances, codes and policies governing such construction and connections; and 4. Should the tract herein referred to cease to be used as a golf driving range cease to exist, the tract will then become subject to the terms of the City of Plainview Subdivision Regulations and shall conform to those regulations before the tract is used for any subsequent purpose or use other than those permitted in an Agricultural Zone.
