HomeMy WebLinkAboutR92-124Texas Alcoholic Beverage Code Resolution No. R92-124 A RESOLUTION OF THE CITY OF PLAINVIEW, TEXAS, EXPRESSING SUPPORT OF PASSAGE OF LEGISLATION IN THE TEXAS LEGISLATURE WHICH WOULD ALLOW HOME RULE MUNICIPALITIES TO REGULATE CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES WITHIN DESIGNATED PORTIONS OF A CITY. WHEREAS, the regular session of the 73rd Texas Legislature will convene on January 12, 1993; and WHEREAS, many legislative issues affecting local government will be considered; and WHEREAS, state law, pursuant to the Texas Alcoholic Beverage Code, preempts local regulation of possession of open alcoholic beverage containers; and WHEREAS, municipalities are better able to address alcohol-related problems of a local nature than the Texas Alcoholic Beverage Commission; and WHEREAS, the City of Plainview would prefer that municipalities be allowed to regulate consumption of alcoholic beverages in public places within certain areas of the municipality: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: Section 1. That the City Council of the City of Plainview supports passage of legislation in the Texas Legislature which would allow Home Rule municipalities to regulate consumption of alcoholic beverages in public places within designated portions of a city. Section 2. That the City Manager is directed to communicate the purpose of this resolution to members of the Sunset Advisory Commission, the Texas Legislature, the Governor, Lt. Governor and Speaker of the House. Section 3. That this resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Plainview and it is accordingly so resolved.
