HomeMy WebLinkAbout96-3087ZONING ORDINANCE - Zone Case 630 C-3 & A to C-2 ORDINANCE NO. 96-3087 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF PLAINVIEW, HALE COUNTY,TEXAS, TO REZONE 5.41 ACRES BEGINNING AT A 1/2 INCH STEEL ROD SET AT THE INTERSECTION OF THE WEST RIGHT OF WAY LINE OF ENNIS STREET AND THE SOUTH LINE OF AN ALLEY, SAID ROD BEING 211 FEET SOUTH AND 50 FEET WEST OF A SPIKE AT THE NORTHEAST CORNER OF SURVEY NO. 29, BLOCK JK-2, HALE COUNTY, TEXAS; THENCE SOUTH 580.11 FEET ALONG THE WEST RIGHT OF WAY LINE OF ENNIS STREET TO A 1/2 INCH STEEL ROD: THENCE S. 89°52'30"W. 406.6 FEET ALONG THE NORTH RIGHT OF WAY LINE OF SOUTHWEST 5TH STREET TO A 1/2 INCH STEEL ROD; THENCE NORTH 560.98 FEET ALONG THE EAST LINE OF AN ALLEY TO A 1/2 INCH STEEL ROD; THENCE N.45° E. 28.28 FEET ALONG AN ALLEY CUTBACK TO A 1/2 INCH STEEL ROD; THENCE EAST 386.6 FEET ALONG THE SOUTH LINE OF AN ALLEY TO THE POINT OF BEGINNING. (310 S. Ennis Street), FROM C-3, COMMERCIAL-3 AND AGRICULTURE DISTRICTS TO A C-2, COMMERCIAL-2 ZONING DISTRICT; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth in Section 5 the requirements for amending the zoning map of the City of Plainview, Texas; and WHEREAS, Michael Lowe (Tusha Buildings) on behalf of Dr. Mike Hinze (Plainview Christian Academy) have requested that property located generally at 310 S Ennis Street be rezoned from a C-3, Commercial-2 Zoning District and A, Agriculture Zoning District to a C-2, Commercial Zoning District; and WHEREAS, notice of a public hearing to discuss said rezoning was published in the Plainview Daily Herald before the 15th day prior to the hearing date; and WHEREAS, said hearing was held in the Council Chambers of the City Hall, Plainview, Texas, at which time persons appeared in support of the proposal; and 1 of 3 WHEREAS, the proposed rezoning, as hereinafter made, has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council; and WHEREAS, it was determined by the City Council that it would be in the best public interest to rezone the property as described below in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Plainview, Texas that: SECTION I The request of Michael Lowe (Tusha Buildings) on behalf of Dr. Mike Hinze (Plainview Christian Academy) to rezone 5.41 acres beginning at a 1/2 inch steel rod set at the intersection of the west right of way line of Ennis Strut and the south line of an alley, said rod being 211 feet South and 50 feet West of a spike at the northeast corner of Survey No. 29, Block JK-2, Hale County, Texas; Thence South 580.11 feet along the West right of way line of Ennis Street to a 1/2 inch steel rod; Thence S. 89°52'30"W. 406.6 feet along the north right of way line of Southwest 5th Street to a 1/2 inch steel rod; Thence North 560.98 feet along the east line of an alley to a 1/2 inch steel rod; Thence N.45° E. 28.28 feet along an alley cutback to a 1/2 inch steel rod; Thence East 386.6 feet along the south line of an alley to the Point of Beginning. and known as 310 S. Ennis Street, from C-3, Commercial-3 and Agriculture districts to a C-2, Commercial-2 Zoning District. SECTION II Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION IH All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION IV Should any section, subsection, or any portion he~eof be deemed invalid for any reason, such holding shall not render or inValidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. 2 of 3 SECTION V This ordinance shall be of full force and effect upon its passage and publication as required by law.
