WHEREAS, on September 22, 2009, through the adoption of Ordinance No. 09-
3516, the Plainview City Council approved the 2009 -2010 Budget; and
WHEREAS, the Budget is a general guideline for revenue and expenditures and
may require periodic amendments; and
WHEREAS, the City Manager has certified that there are available for
appropriation revenues /reserves in excess of those estimated in the budget; and
WHEREAS, Texas Local Government Code Ann., Section 102.010 (2008) allows
municipalities to make changes in the budget for municipal purposes; and
WHEREAS, the Plainview City Council has determined to amend the 2009 -2010
Budget to make appropriations for the year for certain accounts not to exceed such
excesses.
NOW, THEREFORE, THE CITY OF PLAINVIEW HEREBY ORDAINS that the
2009 -2010 Budget is amended to appropriate excess revenues /reserves in the general
and various revenue and capital funds for the following accounts:
SECTION I
ORDINANCE NO. 10 -3534
AN ORDINANCE OF THE CITY OF PLAINVIEW AMENDING
ORDINANCE NO. 09 -3516 TO APPROPRIATE FUNDS IN THE
GENERAL FUND AND VARIOUS REVENUE AND CAPITAL FUNDS
PURSUANT TO SECTION 5.07 (a) and (d) OF THE PLAINVIEW CITY
CHARTER ALLOWING FOR SUPPLEMENTAL APPROPRIATIONS IN
THE 2009 -2010 BUDGET; CUMULATIVENESS CLAUSE; CONFLICTS
CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE.

SECTION II
Provisions of this Ordinance are cumulative, and nothing herein shall prevent,
alter, or diminish the applicability or enforcement of other Ordinances restricting,
regulating, or governing the subject matter herein.
SECTION III
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision, and such
holding shall not affect the validity of the remaining portions hereof.
SECTION IV
All Ordinances or portions of any Ordinance of the City of Plainview, Texas, in
conflict herewith are hereby amended to conform with the provision hereof.
SECTION V
This ordinance shall be of full force and effect upon its passage and publication
as required by law.
