.ORDINANCE NO. 86-2642
AN ORDINANCE OF THE CITY OF PLAINVLEW, REGULATING THE ERECTION,
CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING REMOVAL
DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT USE, .HEIGHT, AREA
AND MAINTENANCE. OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY
OF PLAINVIEW, TEXAS:- PROVIDING FOR THE ISSUANCE OF .PERMITS AND
COLLECTION OF FEES.,. THEREFORE; PROVIDING PENALTIES FOR THE
VIOLATION THEREOF; DECLARING AND ESTABLISHING FIRE ZONE;
REPEALING ORDINANCE NO. 82-2.498 OF"THE CITY OF PLAINVIEW, AND ALL.
OTHER. ORDINANCES AND PARTS OF ORDINANCES..IN CONFLICT HEREWITH,
PROVIDING FOR.:.THE:ADOPTION OF THE T985 EDITION OF THE UNIFORM
BUILDLNG CODE, VOLUME: 1, AS COPYRIGHTED LN 1985 BY THE
INTERNATIONAL ,CONFERENCE OF BUILDING OFFICIALS, WHITTLER,
CALIFORNIA, WITH CERTAIN.AMENDMENTS, THERETO; DIRECTING
PUBLICATION 'OF THE`DESCRIPTIVE CAPTION OF THIS ORDINANCE, WITH
THE PENALTY PROVISIONS OF THE UNIFORM BUILDING CODE 1985 EDITION
AND PROVIDING AN EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Council of the City of Plainview has found that
the- present Building Code of the City of Plainview has become
obsolete.-• and,
WFTRRI?AS, the City Council appointed the Fire Code/Building Code
Board of Appeals to prepare .recommendations for the City Council in
regard to _a new. Building Code; and'
WHEREAS, the Fire Code/Building Code Board of Appeals recommends
the Uniform Building Code, 1985 Edition, with certain amendments
thereto; be adopted..as the .building. Code of the Ci y of Plainview;
NOW THISREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS:
SECTION 1. That the .Uniform Building Code, 1982 Edition ( being
Ordinance'No. 82-2498 of the City of Plainview) be,
and the-same is. hereby :repealed...
SECTION 2. That the-1985 Edition of the "Uniform Building Code",
Volume.. 1, as copyrighted in 1985, by the
Lnternatonal Conference of Building Officials,
Whittier; California, as hereinafter amended. is
specifically adopted as the Building Code of the .City
of Plainview, Texas; and a copy is attached hereto
and incorporated herein by reference as though set
out .completely in detail.
A copy of said Uniform Building Code shall be filed with the City
Secretary and a copy, maintained in the- office of .the Building
Officia of the _City of ;Plainview, ..Texas, .all such copies to be -open

with the following amendments thereto;
SECTION 3. That Chapter 2 Section 205, of the "Uniform Building
Code"; 1985. Edition, shall be and the same ,is hereby
amended by the<addition thereto of anew paragraph.:.
which shall read as followsc
":Any person, firm, or corporation violating any of
the provisions-of this. Coder shall be deemed guilty
of a misdemeanor, and each 'such person shall.... be
deemed guilty of a separate' 'offense for each- and
every :day oz portion thereof during which and
violation of any of the provisions of this Code is
committed, continued, or permitted,: and upon'
conviction of any such violation such person shall

SECTION 4. That Section 302 (b), Chapter 3 of the "Uniform
Building Code" 1985 Edition, shall be and the same
is hereby amended to reads
"Plans and Specifications. With each application
for a bulding.permit and when required by the
Building Official for enforcement of any provisions
of .this code, two sets of plans and specifications
shall be submitted: The Building Official shall
require .Plans .and specifications to be prepared and
designed by an-engineer or architect licensed by the
State to practice as such:
EXCEPTION: The Building official may waive the
submission of plans.,. calculations, etc., if he finds
I the nature of the work applied. for is such that-
: reviewing of "plans is not necessary to obtain"
compliance with thin code.
SECTION 5. Tha Section 304,"(b)-and (c), of the "Uniform
Building Code.", 19.85 Edition,. shall be amended to
read as follows:
"(b) Any person desiring a building permit shall at
the time of filing `an application therefore, as
provided in Section 301. of this Code, pay to the
Building Offical a fee as required in the Section:
Building Permit fees shall be as set out by separate
ordinance.'

for each additional re-inspection shall be charged.
.The re-inspection fee must be paid at the City Hall
.before a further inspection will be made.
(c) Plan Checking fees. Whenever a plan is required
to be. submitted by.sub-section (b), Section 302, of
the "Uniform Building Code" adopted'in Section 2 of
-this. ordinance, a Plan Checking fee shall be paid to
the Building Official at the time of submitting the
plans"and specifications for checking.. Said Plan
Checking fee shall be equal to one-half of the
Building Permit fee as set out by special ordinance.
SECTION 6: That Chapter 3 of .the "Uniform Building Code", 1985
Edition is hereby amended by and adding thereto a
section. to be known as Section 308 to read as
follows
SECTION 308: (A) No person or persons shall
hereafter move any building, house or structure
within the limits of the City of Plainview, Texas,
where the saline shall be moved in, through or upon
the streets, alleys,. avenues ,. or public grounds
unless said. person shall, before moving said
building house or structure, secure a'permit to do
so from the Building Official of the City of
Plainview, Texas.
(B) No person or persons .shall hereafter move any
building or structure from within or from outside
the city limits of the City of Plainview, Texas,
to any place within the city limits of the City of
Plainview, Texas, or cause the same. to be done,
without first obtaining a separate building permit
f'br each building or structure from the Building
Official of the City. of Plainview, Texas.
(G) Whenever any person or persons shall make an.
application for a Building permi fora building
or structure which is to be moved from outside the
city `limits of the City of Plainview, to a place
inside the city limits, he said.. person shall
deposit with the Building Official a sum of money
equal to Twenty Cents (.20~ ) per mile for each
mule necessary to travel from the city limits of
Plainview to the building and return to the city
limits of the Citg of Plainview; plus a sum of
'money equal to the sum of Eight and No/100 dollars
($8.00) per hour based upon the Building
Official's estimated time .required. to make the
.inspection and in traveling to said .building and
returning to the city limits of the City of
Plainview. Said deposit shall become the property
of the City of Plainview and is to pay for the

extra.expense in inspecting-said building and
shall not be returned to the person making
.application regardless of whether or not the
Building Permit is issued. Such payment shall. be
iri addition to the regular. fees. required for
issuing a building permit as set out, and
prescribed by special ordinance.
{D) The Building Official may designate a
competent: deputy to make such 'inspection for
him, who shall, in such event, be paid the sum
of Twenty :Cents (20~) per mile for travel
outside the city limits of the City of
I Plainview in making. the inspection,.. plus the
amount of `Eight dollars ($8.00)'perhour for
~,II, each hour of time necessary;.to make. the
inspection and 'travel from 'the city. limits of
the City of Plainview to said place where the
~'' building or structure to be inspected is
located and return`to the city limits of the
City of Plainview.
SECTION 7:' That Chapter 5, .Section 503 (d) of the "Uniform
Building Code"; 1985 Edition, shall be and. the same
is hereby,: amended by the addition thereto of anew
paragraph which shall read-as follows.:
:'EXCEPTION. 4: Occupancy Graup R buildings with an
.attached garage and in Fire Zone No. 3 shall not be
required to have one hour fire resistive separation.

SECTION 8c That Chapter 16, Section 16.01 (a) shall be added to
the .1985 .Edition of'the "Uniform Building Code" to
include:: the following. paragraph. to read as follows:
"That the entire incorporated area of the .City of
Plainview is'hereby declared to be and is hereby

established as afire district,..and said fire
~I district shall be known and designated as Fire Zone
1; 2, and 3, and each zone shal include such
erritory and. portions of the City of Plainview as
follows':
ZONE 1 shall include the territory as' set out and
described by metes; and bounds as Zone 1 under Chapter
9, Article'1, Secton`9.1 (a) of the Municipal Code
o.f the City of Plainview, as adopted 1978.
ZONE 2 shall include the territory as set out and
:described-by metes and bounds as Zone 2 under Chapter

ZON£ 3 shall include all of the territory within the
city limits of the City of Plainview, not included in
Zone l"and 2.
- Said .Zones. 1, 2, and 3 of the City of Plainview are
hereby. adopted as the fire zones of the City of
Plainview, for..the publication of the regulations
included in-the said "Uniform Building Code"', 1985
Edition.
SECTION 9: That Chapter 22 of the "Uniform Building-Code", 1985
Edition'is hereby amended by adding thereto a section
to be known as Section. 2205, which. said section shall
read as follows:

SECTION'll; Section 2903 (A) of Chapter 29 of the "Uniform
Building Code", 1985, Edition shall. be amended to
include anew Table to be designated as Table 29A-1,
and by the. addition to read as follows:
SECTION 2903 (b) Genezal.- The classification of the
soil under all portions of every building shall be
based upon the examination of adequate test borings
or excavating made at the site .when required by the
Building Official. The:. location of the test boring
or: excavations and the 'nature of the'. sub-surface
materials shall. be indicated on the plans.
EXCEPTION: Design criteria for foundation and
footings in one and two story. building housing. groups
R-3 .and M-l Occupancies, Type V Construction, where
engineering design is notprovided shall be set for. ~.,
in .Tables 29-A and 29-A1. ~~.'

SECTION 12 That Section 2907 (A) of Chapter 29 of the "Uniform
Building Code.", 1985 Edition shall be amended to
read"hereafter as follows:
(a} General.' Footings and Foundations, unless
otherwise specifically provided, shall-be constructed
of'solid masonry or concrete and shall be in all
cases .extended-below the front.. line.., Foundation
walls supporting wood shall.:. extend at lease eight
inches {8") above the finish grade adjacent to the
wall at all points. Footings shall have a minimum
depth as indicated in Table No-. 29-A unless another
depth is recommended by a foundation investigation.
SECTION 13: That Section 2517 (g) 1. of Chapter 25 of the
"Uniform Building Code," 1985 Edition shall be
amended by adding the following:
A11 exterior and interior walls of conventional,
light-frame construction shall'be framed on 16"
centers with not less that 2 inch by 4 inch material.
SECTION 14: That Chapter 25 Table No. 25-R3, of the "Uniform
Building Code,°'..1985 .Edition is hereby amended to
read as follows:

1 Utility grade studs shall not be spaced more than 16.inches on center, nor
support more than a roof and ceiling., nor exceed 8 feet in height for
exterior walls and load bearing or 10 feet for interior non-load bearing
walls.
2 Shall not. be used in exterior walls.
3 Listed heights are distances between points of lateral support placed

SECTION 15: Severablity .Clause, ~If any provisions of this
Ordinance or of the Code hereby adopted or the

held invalid,. the remainder of the Code, and the
.application of such provisions to other persons or
circumstances, shall"not be affected thereby,
SECTION 16: . The City Secretary is hereby authorized and directed
to cause the publication of the descriptive .Caption
of this Ordinance together With the penalty
provisions as provided herein. This Ordinance shall
become effective after its passage and publication as
"required..by ,law.
