CHAPTER 22, PLALNVIEW CODE TO ESTABLISH RULES AND REGULATIONS`FOR GOVERNING AND PROTECTING PUBLIC PARRS AND PLAYGROUNDS.; PROVIDING :FOR ENFORCEMENT; and PROVIDING-FOR A PENALTY. WHEREAS, the City Council- of the City of Plainview, Texas finds a need to establish rules. and regulations for the government and. protection of the public parks and playgrounds of the City of Plainview; and WHEREAS, the City Council further finds that it-would be in the best interest of and would promote the safety and welfare of the users of city parks and playgrounds, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS. THAT: Art. IV, Section 22-41. et seq., are hereby created as follows ~- Section 22-41: Park hours and use. It shall be unlawful for any person in any public- park or playground to: A. Enter into, remain., or. use any. portion of the..public .park or playground between the hours of 12:00 'midnteand 7:00 a.m. unless duly authorized by the . City 'Manager or his designated representative.. B. Use any park .area of any public park or playground for camping-, tenting, or recreational vehicle parking except. in those areas specifically designated: and authorized by the Superintendent of Parks... `C._ Leave adesignated.area before any outdoor fire is completely extinguished and before all trash in the ..area- is placed. in a trash receptacle or otherwise removed and properly disposed thereof.. D. Build or attempt to .build a fire, except in. fire places, barbecue pits or other such areas as are permanently fixed to the ground and under such regulations as may be so designated by the Park ~. Superintendent in the interest of safety. _. _. _ Q - 1 E. Use any_ park or playground, in an area not designated as a camping area, as a permanent or .temporary .residence: -Evidence of 'residence includes, but is not limited to, cooking, sleeping, or use of the restroom.:.facilites in such a manner is to indicate the act of or fact of residing. Section 22-42: Enforcement. Compliance with -.the rules and regulations of this Article:: is` a condition precedent to the use of the public parks and .playgrounds of the`city and any person charged with the supervision and'care of said parks and playgrounds and law enforcement officers shall have authority to enforce the ~ provisions:. of this article by expulsion from .said, park or playground or by arrest of the offender if such official is a law enforcement officer ~' Section 22-43: Conflicts. ~, All ordinances or.part'of`any ordinance of the Gty of Plainview,. Texas, in conflict with the provisions of thin ordinance are hereby repealed. ' Section 22-44: Penalty. ~,, Any .:person-who shall violate. or fail to comply with any of the provisions of this ordinance:: shall be deemed `guilty of a misdemeanor-and upon conviction shall be punished by a: fine -not to exceed two hundred ($200.-00) dollars. Section 22-45s Severability. WHEREAS, the City Council of the City of Plainview, Texas finds a need to establish rules and regu ations for the ..government and protection of the. public parks and playgrounds of the City of Plainview; and WHEREAS; the City Council further finds that it would be in 'the .best interest of and would promote the safety and welfare of the users of city parks and playgrounds, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE. It -shall be unlawful for any person in .any public park or playground to:. A. Enter into, remain, or use any portion of the public park or playground. between the hours of 12:00 midnite and 7:-00 a.m. unless duly authorized under . the provis-ions of this article. B. Use any park area of any public park or playground for camping, tenting, or recreational. vehicle _parking except in those areas specifically designated and. authorized by the Superintendent of Parks. C.. Leave a designated area before any outdoor :fire is .completely extinguished and before all trash in the area is placed in a trash receptacle or otherwise .removed and properly disposed thereof. D. Build or attempt to build a fire, except in fire places; barbecue pits or other such areas. as are permanently fixed to the ground and under such -~ regulations as may be so designated by the Park :Superintendent in the interest of safety. E. Improperly sleep in any park-area which is not a ,t, .<, ~~ '~' a ,designated camping area:. ;~~ Section 22-42: Enforcement. Compliance with the rules and regulations of this Article is a condition precedent to the use of the :public parks and .:playgrounds of the city and any person charged with the supervision and care of said parks and playgrounds and law enforcement officers shall have authority to enforce the provisions of this article by expulsion from said park_or playground or by arrest of the offender if. such official is a law enforcement offcer.- Section 22-43: Conflicts. Ala ordinances ,or part of any. ordinance of ,the City of Plainview, Texas, is conflict with the. provisons`'of this. ordinance are hereby repealed. Section 22-44: Penalty. Any .person who shall violate or fail to comply. with any _ " `ance shall ,be deemed uilty of of the provisions of this ordin 9' ~, a misdemeanor and upon conviction `shall"be punished by a fine not to exceed two hundred ($200.00) dollars. - Section 22-45: Severability.. '~ Should any, section, paragraph, sentence,.. clause, phrase, I or word of this ordinance be -declared unconstitutional or invalid for any purpose, the remainder of-this Ordinance 'shall be effected thereby.
