ORDINANCE NO. 85-2668
AN. ORDINANCE AMENDING CHAPTER XX, PLAINVIEW CODE TO
.REPEAL. PROVISIONS THEREIN CONCERNING NOTICE TO ABATE A
NUISANCE.
WHEREAS,, it is deemed by the City Council of the City
of Plainview,- Texas, that it is dangerous to the public
-health, safety, and welfare for conditions commonly known
as nuisances to exist; and
WHEREAS., it_is expressly. provided bar the provisions of
Tex. Rev.Civ. Article 4436, that City's shall have the
power to correct the evils resided therein; and
WHEREAS, the City Council finds it would be in the
best interest of the citizens of Plainview to require
prompt and immediate attention_to abate a nuisance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF PLAINVIEW, TEXAS, THAT:
Art. I, Section 20-4. et seq., are hereby repealed
and/or amended as follows:
Section 20-4. Notice to abate..
Repealed.
Section 20-5. Contents of notice.
Repealed.
..Section. 20-6. Service of citation.
The service. of citation on a nuisance violation shall
be served as any other legal process may be served
pursuant to law.
Section 20-7. Abatement by City.
Upon the failure of the person upon whom citation has
been served pursuant to the provisions of this
Chapter, the Health Officer or other duly designated
Officer of the City may proceed to abate such
nuisance and shall prepare a statement of cost
incurred in the abatement thereof.
