First item on the agenda: Approval of June 2002 minutes. Fred Willis made motion to approve
minutes. John Bickel seconded the motion. Motion carried 4-0.
Second item on the agenda: The request of Rick Pledger for a variance of twenty (20) feet of the
required twenty-five (25) foot front setback and five (5) feet of the required five (5) foot side setback as
stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 30' X 24' carport in a
Single-family Residential (R-2) Zoning District, and being Block B-10, Lot 3, Wayland Heights Addition,
Plainview, Hale County, Texas the same being 109 SW 9t~ Street. Mr. Pledger is present to answer
questions from the Board. He stated he needs protection for large vehicles, a flatbed trailer and a jeep,
which he currently parks beside the house. He added that he had spoken to all his neighbors and none of
them were opposed to the carport. John Castro showed photographs of where Mr. Pledger's double gate
where he backs his trailer. John Castro told the Board that most carports the Board has approved have
been no larger than twenty-four feet by twenty-four feet (24' X 24') but this carport's length is thirty (30)
feet. If the variance is approved, then Mr. Pledger can build the thirty (30) foot carport as requested. He
added there is no way to get around the side setback due to the. existing gate. He said staff has a concern
about the length of thirty (30) feet, but said this would not extend the proposed carport any further than
existing carports in the area since it would be placed next to a cut-away portion of the house. There were
6 responses received, all in favor of the variance. Fred Willis asked how far out would the carport extend
and John Castro said it would put him five (5) feet off the front property Dine. Fred Willis asked if the
carport would be taller than the eave of the house and Mr. Pledger stated it would be placed under the
eave. John Bickel asked why is he requesting such a long carport and Mr. Pledger replied that he has a
Tahoe and an extended cab four wheel drive pick-up that are both too large to get into the garage. Mr.
Pledger said he has to redo his driveway since water drains into his house and he felt that since he was
doing that, he would go ahead and build a carport. Arturo Ortiz asked if the roof of the carport would be
sloping toward the street for water drainage and Mr. Pledger said it would. John Bickel asked is staff
concerned with the length due to some safety issue and John Castro stated it is just longer than other
carports the Board has approved, and again he said this carport would not extend further out than other
carports in the area and it will be located partially beside the house and not totally in front of the house.
Fred Willis made motion to approve the variance based on this being the only logical location for the
carport and the positive response from neighborhood. Armro Ortiz seconded. Motion carded 4-0.
Third item on the agenda: The request of Tomas and Dolores Estrada for a variance to expand on a non-
conforming use as stated in Section 35 of the City of Plainview Zoning Ordinance to add-on a 9'X27'6"
room in a Heavy Manufacturing (M-2) Zoning District, and being AB 859 PRE M A LOWE OF 79 AC
OUT NW/C EXC .21 OFF E. SIDE .58 ACRES, Plainview, Hale County, Texas the same being 1005 E.
12th Street. Thomas and Delores Estrada are both present to answer questions of the Board - Delores will
interpret for Thomas. John Castro stated this is a legal non-conforming use residential structure in a
heavy manufacturing zoning district. It was in existence before the area was zoned heavy manufacturing.
There was one (1) positive response from the neighborhood and zero (0) negative responses received.
The property owners want to add to the East side of the house and they need a variance of at least 10 (ten)
feet. There is one other residential structure in this area - right next door. Fred Willis asked will a
contractor do the addition or will they do it themselves? Delores asked Thomas and the response was
they would do it themselves. Fred Willis asked if the City has set standards of engineering? John Castro
stated the City would provide the drawings for the footing or piers, whichever the homeowner is using.
Span tables are also provided for the type of materials to be used to construct the addition and the City
will closely inspect the addition. Armro Ortiz made motion to approve the variance based on no negative
response from neighborhood and no negative impact by the addition. John Bickel seconded the motion.
Motion carried 4-0.
Fourth item on the agenda: The request of Joyce Patton for a variance of nineteen (19) feet of the
required twenty-five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning
Ordinance to construct a 20' X 13' carport in a Single-family Residential (R-2) Zoning District, and being
Block 18, Lot 21, Thunderbird Addition, Unit 4, Plainview, Hale County, Texas the same being 1406
Thunderbird Drive. Joyce Patton is present with her son-in-law, Paul Nolen, who will be building the
carport if the variance is approved. She said she is seeking protection from the elements as well as from
the birds in the tree. John Bickel asked if there was any other place she could put the carport and Ms.
Patton said there is no other place. John Castro said the proposed carport would be lined up with the side
of the house and extend twenty (20) feet. The reason for the variance of nineteen (19) feet of the required
twenty-five (25) feet is because the front of the house is twenty-six (26) feet off the property line and the
setback is twenty-five (25) feet and she can build in the first foot. There were two (2) responses received,
both in favor of the carport. Fred Willis said there are several existing carports in the area. John Bickel
asked why she doesn't use the garage and Ms. Patton said her vehicle is too long as well as too wide for
the carport. Ray Jameson inquired about the direction water would drain off the carport and Mr. Nolen
said it would drain toward the street and a gutter would eventually be added for drainage. Armro Ortiz
made motion to approve the variance due to this being the best logical place for the carport and there are
several other carports in the area as well as positive feedback received from the neighboring property
owners. Fred Willis seconded the motion. Motion carried 4-0.
Fifth item on the agenda: The request of Brad Edwards for a variance of fifteen (15) feet of the required
twenty-five (25) foot front setback and three (3) feet of the required five (5) foot side setback as stated in
Section 34 of the City of Plainview Zoning Ordinance to construct a 24' X 24' carport in a Single-family
Residential (R-2) Zoning District, and being Block 3, Lot 16, Boynton Addition, Plainview, Hale County,
Texas the same being 217 SE 9th Street. Brad Edwards is present to answer questions of the Board. Mr.
Edwards said he wants a carport since his vehicle will not fit in his garage due to the size of the vehicle.
John Castro said the concrete for the twenty-one (21) foot driveway is two (2) feet from the side property
line. The reason for the fifteen (15) feet of the required twenty-five (25) foot front setback is because the
front wall of the house is thirty-five (35) feet from the front property line, and there is only a required (25)
foot front setback. The carport will be freestanding, not against the house. Mr. Edwards said his
driveway does not properly drain and he would like to redo a portion of the driveway to correct this while
constructing the carport. He added that there are other carports in the neighborhood. There were five (5)
responses received from neighboring property owners, all in favor of the variance. Fred Willis made
motion to approve the variance based on positive response from the neighborhood and this being the best
logical placement of the carport. John Bickel seconded the motion. Motion carded 4-0.
Sixth item on the agenda: The request of Placido & Julia Castro for a variance of six (6) feet of the
required eight (8) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to
construct a 40' X 14' carport in a Single-family Residential (R-l) Zoning District, and being Block 1, Lot
10, Rowe-Goode Addition, Plainview, Hale County, Texas the same being 1208 Raleigh Street. Placido
Castro and Manuel Marin, Mr. Castro's son-in-law who will assist in translating for Mr. Castro, are both
present to answer questions from the Board. John Castro showed the Board a drawing of the property,
illustrating the gas and water lines. John Castro said this property owner needs eight (8) feet on the side
because this is an R-1 zoned property. John Bickel said there is no request at all for the front setback.
Due to the water and gas line placement on the property, John Castro said the requested variance is the
only logical place for a carport which would put it two (2) feet of the side property line. John Bickel
asked if there would be any problem with the carport and the neighbor's garage being so close together in
the event of a fire. John Castro said there is an alley that would allow access for emergency vehicles.
Manuel Matin said there is a fence that separates the properties. There was one response received in
favor of the variance. John Castro said there will be a gap between the existing garage and the proposed
carport. Manuel Marin said this is because Placido Castro works on a farm and often has muddy feet and
he will be entering the residence from a side door, accessible from the proposed carport. Armro Ortiz
asked which direction would the roof of the carport slope and Mr. Marin said it will slope toward the
street and there will be rain gutters attached. John Bickel asked if the carport would match the
architecture of the existing garage and Mr. Marin said it will be a little lower in height than the garage but
the architecture should match Armro Ortiz made motion to approve the variance based on this being the
only logical location for the carport and no negative response from the neighborhood as well as other
carports in the neighborhood. John Bickel seconded the motion. Motion carried 4-0.
