HomeMy WebLinkAbout06.24.1999 BA Minutes ]UNE 1999 BOARD OF AD]USTNENT MINUTES BOARD MEMBERS PRESENT: Ray Jameson, Cezar Cervantez, Ronnie Miller, Max Browning STAFF MEMBERS PRESENT: Secretary of Board of Adjustment John Castro, Director of Community Development, Kristin Page, OTHER GUEST: Garcia Sr., Jay Laird Jimmy Tyler, Richard Rubio, Robert Ortega, Mary & Doyle Driver, Benito First item on the agenda, approval of minutes, Max Browning made motion to approve minutes as read and Cezar Cervantez seconded. Motion carried 4-0. Second item on the agenda, Case # 1339, the request of Gerardo Fernandez for a variance of twenty (20) feet of the required twenty-five (25) foot front setback and one (t) foot of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to erect a 20' X 19' carport in a Single Family Residential (11-2) Zoning District, and being Lot S.19'-2 N.31'-3, Block 2, Gardenville Addition, Plainview, Hale County, Texas and same being 2513 Rochelle Street. The variance of twenty (20) feet should have stated five (5) feet instead. All Mr. Fernandez needs is four (4) feet because he is akeady up to twenty (20). The staff does not have a pioblem with this. There were four (4) in favor responses in all. Ronnie Miller made motion to approve the variance, Max Browning seconded. Motion carried 4~0. Mr. Castro requested that Case # 1340 be moved to the last item on agenda for Mr. Ulmer to be given opportunity to speak. Third item on the agenda, Case #t341, the request of Benito & Maria Garcia for a variance of nine (9) feet of the required twenty,five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to erect a 19' X 14' carport in a Single Family Residential (R-2) Zoning District, and being Lot 5, Block 2, Merryman Addition, Plainview, Hale County, Texas and same being 1208 E1Camino Street. The Garcia's also own the side lot beside their house. They want to put the carport in the front instead of on the side of the house, because they don't want to tie up two lots in case they want to build a second house on the other lot, they would not be able to if the carport was on the side of the house: Your only allowed one residence per lot. The staff has no problem with this. There was one (1) in favor response. Cezar Cervantez made motion to approve the variance, Ronnie Miller seconded, Motion carried 4-0. Fourth item on the agenda, Case #1343~ the request of Robert & Maria Ortega for a variance of twelve (12) feet five (5) inches of the required twenty-five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to erect a 17' X 20' carport in a Single Family Residential (1l-2) Zoning District, and being Lot 6, Block 3, Boynton Addition, Plainview, Hale County, Texas and same being t20 SE 8~h Street. They received one (1) in favor response. The staffhas no problem with this. Ronnie Miller made motion to approve variance, Max Browning seconded. Motion carried 4-0. Fifth item on the agenda, Case #1344, the request of Jay Laird for a variance of two (2) feet of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to erect a 12'6"X 19' 5" carport in a Single Family Residential (R-2) Zoning District, and being Lot E/2 13 &14, Block 10, Highland Addition, Plainview, Hale County, Texas and same being 1310 W. I0t~ Street, The lots run East to West. He is requesting a variance of 2 ft. of the required 5 ft setback within 3 ft of the property line. It would be right up against the fence. The fence is 3 R from the property line. No front setback is required, Max Browning made motion to approve variance, Ronnie Miller seconded. Motion carried 4-0. Sixth item on the agenda, Case # 1340, the request of Jimmy Tyler for a variance of thirty (30) feet of the required thirty (30) foot front setback and ten (10) feet of the required ten (10) foot side setback as stated in Section 34 of the City of Ptainview Zoning Ordinance to erect a 24' X 19' carport and a 20' X 11' carport in a Single Family Residential (R-I) Zoning District, and being Lot 10, Block 4, Bell Subdivision, Plainview, Hate County, Texas and same being 2711 W. 3~a Street. There were three (3) in favor responses and the staff has no problem with this. Mr. Tyler and Mr. Ulmer had talked about putting a fence all the way out to his property line, in between Mr. Tyler's carport and Mr. Ulmer's house. Mr. Ulmer explained his point of view for the purpose of the fence which it would cut down the noise coming from Mr. Tyler's drive, since Mr. Utmer's bedroom is on that corner of the house. The distance between the two house is 5 ft. Between the two parties, they do not have any problems with this. Mr. Tyler would not have to have a variance to put up a fence, but Mr. Ulmer would. Since that is Mr, Tyler's property. They agreed on a 6 ft fence all the way across to his property line or to a certain point and then eventually drop it down to 3 ft. The staffhas no problem with this. Ronnie Miller made motion to approve variance, Cezar Cervantez seconded. Motion carried 4-0.
