BOARD OF ADJUSTMENT
MINUTES
BOARD MEMBERS PRESENT: Ray Jameson, Cezar Cervantez, Joe Rodriguez Jr., Fred Willis
STAFF MEMBERS PRESENT: John Castro, Director of Community Development, Kristin
Page, Secretary of Board of Adjustment.
OTHER GUEST: Tom Burress, Rosendo Cantu
First item on the agenda, approval of September 1999 minutes. Fred Willis made motion to approve minutes
as read and Cezar Cervantez seconded. Motion carried 4-0.
Second item on the agenda, Case # 1350, the request of Tom and Amy Burress for a variance of twenty (20)
feet of the required twenty (20) foot side setback as stated in Section 34 of the City of Plainview Zoning
Ordinance to build a 30' X 20' garage in a Single Family Residential (R-I) Zoning District, and being S.20'
Lot 9 and Lot 10, Block 17, Brock Addition, Unit 4, Plainview, Hale County, Texas and same being 1101
Holiday Street. There were three (3) in favor responses received. There is no rear set back requirement, so
Mr. Burress can put his accessary building right up against the rear property line, since it is not opening to the
alley. John Castro suggested that Mr. Burress might have to settle with lowering the height of his building and
a flatter roof. Cezar Cervantez asked Mr. Burress if that would be a problem to adjust the height and Mr.
Burress replied that he has looked at other buildings at the lower height and he has no problem with it. Mr.
Burress stated that he was going to use the upper space for storage. Cezar Cervantez made motion to approve
this variance, because this would be the most reasonable spot within this property to place a structure of this
type, with the stipulations of it not exceeding 12 ft. from the bottom to the peak of the roof. Fred Willis
seconded. Motion carried 4-0.
Third item on the agenda, Case//1351, the request of Rosendo Cantu for a variance of nine (9) feet of the
required twenty-five (25) foot front setback and five (5) feet of the required five (5) foot side setback as stated
in Section 34 of the City of Plainview Zoning Ordinance to build a 17' X 20' carport in a Single Family
Residential (R-2) Zoning District, and being Lot W.30'-17 E.20'-I 8, Block 5, Gardenville Addition, Plainview,
Hale County, Texas and same being 2106 W. 26th Street. There were two (2) in favor responses received.
John Castro did state that this property is in a R-2 zoning district, that means it has a 25 ft. setback. The house
sits 36' from the front property line so Mr. Cantu can build in the first 11' but needs a variance of an additional
9' to build his 17' x 20' carport. Fred Willis made motion to approve this variance and Joe Rodriguez Jr.,
seconded. Motion carried 4-0.
Fourth item on the agenda, Case # 1352, the request of Jerry Murry for a variance of eleven (11) feet of the
required thirty (30) foot front setback and eight (8) feet of the required eight (8) foot side setback as stated in
Section 34 of the City of Plainview Zoning Ordinance to build a 18' X 35' carport in a Single Family
Residential (R-l) Zoning District, and being Lot 4, Block 5, Country club Place Addition, Plainview, Hale
County, Texas and same being 311 Aileen Street. Mr. Murry was represented by Mr. Rosendo Cantu, who
is a contractor. There were three (3) in favor responses received. Cezar Cervantez made motion to approve
this variance and Fred Willis seconded. Motion carried 4-0.
