R12 -267 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, APPROVING THE REQUEST OF PLAINVIEW YMCA TO HOST THE YMCA TRIATHLON BIKE RACE; AUTHORIZING THE FILING OF THE AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THIS BIKE RACE; DECLARING THAT THE EVENT SERVES A PUBLIC PURPOSE; AND AGREEING TO COMPLY WITH REGULATIONS. WHEREAS, the Texas Department of Transportation owns and operates FM 3466 (SW 3rd Street) in the corporate limits of the City of Plainview; and WHEREAS, the YMCA Triathlon Bike Race will follow a route on the following State owned and operated streets within the corporate limits of the City of Plainview: starting at the YMCA, 313 South Ennis Street, go south on Ennis Street then go east on FM 3466 (SW 3 Street) to Business 1 -27 (Columbia Street), then reverse to go west on FM 3466 to 313 South Ennis Street. and WHEREAS, the City of Plainview received a request from the Plainview YMCA on February 23, 2012; and WHEREAS, the City Council of the City of Plainview finds that such race serves a public purpose in that it increases the public awareness in the importance of physical fitness; and WHEREAS, the City Council of the City of Plainview, Texas finds it in the best interest for the citizens of Plainview that the YMCA Triathlon Bike Race be held this year on May 5, 2012 and use the above stated route; and WHEREAS, the Texas Department of Transportation requires the Local Government to submit a completed AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT OF WAY for the use of FM 3466 in such public events as a bike race sponsored by the Plainview YMCA; and WHEREAS, the City Council designates Mayor John C. Anderson as the City's authorized official. The authorized official is given the power to apply for or terminate such Agreement on behalf of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW THAT: I . The request from Plainview YMCA to host the YMCA Triathlon Bike Race for May 5, 2012 is hereby approved. Res. R12 -266 YMCA Triathlon Page 1 of 2 5 6 ll. The public purpose of the race is to increase the public awareness in the importance of physical fitness. III. Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY with the Texas Department of Transportation is hereby approved. IV. The Mayor is hereby authorized and directed to execute, respectively, on behalf of the City of Plainview, all necessary documents, including the AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY, to complete the bike race preparation process.
