A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS, APPROVING THE REQUEST OF THE
JUNETEENTH PLANNING COMMITTEE TO HOST THE 2012
JUNETEENTH PARADE; AUTHORIZING THE FILING OF THE
AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE
RIGHT -OF -WAY WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION FOR THIS ANNUAL PARADE; DECLARING
THAT THE EVENT SERVES A PUBLIC PURPOSE; AND
AGREEING TO COMPLY WITH REGULATIONS.
WHEREAS, the Texas Department of Transportation owns and operates
U. S. Highway 70 in the corporate limits of the City of Plainview; and
WHEREAS, the U. S. Highway 70 crosses Broadway Street within the
corporate limits of the City of Plainview; and
WHEREAS, the intersection of U.S. Highway 70 and Broadway Street is
the critical vein for parade use;
WHEREAS, the City of Plainview has received a request from the
Juneteenth Planning Committee to host the Juneteenth Parade on Saturday,
June 23, 2012; and
WHEREAS, the City Council of the City of Plainview finds that such
parade serves a public purpose in that the parade recognizes this historic event;
and
WHEREAS, the City Council of the City of Plainview, Texas finds it in the
best interest for the citizens of Plainview that the Juneteenth Parade be held this
year on June 23, 2012 beginning at 10:00 a.m. at the 200 Block of N. Broadway
and conclude at Givens Street Park; and
WHEREAS, the Texas Department of Transportation requires the Local
Government to submit a completed Agreement for the Temporary Closure of
State Right of Way for use of U.S. Highway 70 in such public events as a parade;
and
WHEREAS, the City Council designates Wendell Dunlap as the City's
authorized official. The authorized official is given the power to apply for or
terminate such Agreement on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLAINVIEW THAT:

I .
The request from the Juneteenth Planning Committee to host the
Juneteenth Parade for June 23, 2012 is hereby approved.
II.
The public purpose of the parade is to recognize this historic event.
III.
Submission of the completed AGREEMENT FOR THE TEMPORARY
CLOSURE OF STATE RIGHT -OF -WAY with the Texas Department of
Transportation is hereby approved.
IV.
The Mayor is hereby authorized and directed to execute, respectively, on
behalf of the City of Plainview, all necessary documents, including the
AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY,
to complete the parade preparation process.
