NO, 88-2769, (FLOOD DAMAGE PREVENTION ORDINANCE OF THE. CITY OF PLAINVIEW), BY IDENTIFYING THE APPEALS BOARD AS THE BUILDING CODE AND FIRE CODE BOARD OF APPEALS; PROVIDING SEVERABILITY,CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. Whereas, the City Council of the City of Plainview, Texas, has determined that there is a need for a Flood Damage Prevention Ordinance in the City of Plainview; and Whereas, the Flood Damage Prevention Ordinance provides for an appeals process;. and Whereas, Ordinance No. 78-2198. which was approved on February 14, 1978, designated the Board of Appeals as the official Appeals. Board for matters concerning the Flood Hazard Prevention Ordinance; and Whereas, Ordinance No. 78-2253 which was approved on August 22, 1978, renamed the Board of Appeals as the City of Plainview Building Fire Code Board of Appeals; and Whereas, it has-been determined that the present Flood Damage Prevention Ordinance would be simpler understood if it defined the Appeals. Board by its official name. Now, Therefore, Be It Resolved by the City Council of the City of Plainview, Texas: Section 1: Ordinance No. 88- 769 being the Flood Damage Prevention Ordinance of the City of P ainview be amended by adding to Section 2-Definitions of that Ordinance, the fallowing definition which will read as follows- Appeals Board - means the City of Plainview Building Code and Fire Code Board of Appeals. 1 of 2 ,- Section 2: Severability Clause - if any part of this ~, Ordinance is, or should be held invalid, for any reason, then that fact shall. not .invalidate the entire Ordinance, but the balance thereof shall remain in full force and effect..
