HomeMy WebLinkAboutR12-27850 RESOLUTION R12- 278 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, APPROVING THE REQUEST OF THE PLAINVIEW CHAMBER OF COMMERCE TO HOST THE 2012 ANNUAL PLAINVIEW CHAMBER OF COMMERCE CHRISTMAS PARADE; AUTHORIZING THE FILING OF THE AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THIS ANNUAL PARADE; DECLARING THAT THE EVENT SERVES A PUBLIC PURPOSE; AND AGREEING TO COMPLY WITH REGULATIONS. WHEREAS, the Texas Department of Transportation owns and operates U. S. Highway 70 in the corporate limits of the City of Plainview; and WHEREAS, the U. S. Highway 70 crosses Broadway Street within the corporate limits of the City of Plainview; and WHEREAS, the intersections of U.S. Highway 70 and Broadway Street is the critical vein for parade use; and WHEREAS, the City of Plainview has received a request from the Plainview Chamber of Commerce dated November 5, 2012 to host the annual Plainview Chamber of Commerce Christmas Parade on December 6, 2012; and WHEREAS, the City Council of the City of Plainview finds that such parade serves a public purpose in that the parade celebrates the holiday season as well as recognizes the significance of the local business community in this area; and WHEREAS, the City Council of the City of Plainview, Texas finds it in the best interest for the citizens of Plainview that the annual Plainview Chamber of Commerce Christmas Parade be held this year on December 6, 2012, and use the traditional parade route on Broadway Street, which originates at Broadway Park (Broadway at S.E. 1st Street), and goes north, crossing U.S. Highway 70, and concludes at Santa Fe Depot (Broadway at 12 Street); and WHEREAS, the Texas Department of Transportation requires the Local Government to submit a completed Agreement for the Temporary Closure of State Right of Way for use of U.S. Highway 70 in such public events as a parade; and WHEREAS, the City Council designates Mayor Wendell Dunlap as the City's authorized official. The authorized official is given the power to apply for or terminate such Agreement on behalf of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW THAT: Res. R12 -278 Christmas Parade 2012 Page 1 I . The request from Plainview Chamber of Commerce to host the annual Plainview Chamber of Commerce Christmas Parade for December 6, 2012 is hereby approved. II. The public purpose of the parade is to celebrate the holiday season as well as to recognize the significance of the local business community in this area. III. Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY with the Texas Department of Transportation is hereby approved. IV. The Mayor is hereby authorized and directed to execute, respectively, on behalf of the City of Plainview, all necessary documents, including the AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY, to complete the parade preparation process.
