RESOLUTION NO. R91-103
A RESOLUTION OF THE CITY OF PLAINVIEW AUTHORIZING AN
APPLICATION TO THE TEXAS DEPAR~ OF HEALTH FOR THE
PERMITTING OF A SANITARY LANDFILL; AUTHORIZING
SUBMISSION OF A STATEMENT OF EVIDENCE OF FINANCIAL
RESPONSIBILITY AND EVIDENCE OF COMPETENCY; APPOINTING AN
AUTHORIZED REPRESENTATIVE OF THE CITY; AND CONFIRMING
THE APPOINTMENT OF A CONSULTING AND DESIGNING ENGINEER.
WHEREAS, the City of Plainview, desires to own and operate a
new Type I, Sanitary Landfill; and
WHEREAS, the City of Plainview has been working towards this
end for the past two years; and
W~RREAS, population and solid waste generation have rapidly
increased during the past years; and
WHEREAS, current and anticipated growth and development in
the City of Plainview and the region will result in tremendous
increases in solid waste for the next sixty years; and
WHEREAS, the City adheres to the mandate of improving and
maintaining the environment and health of its citizens based on
cost benefit analysis; and
WHRREAS, the City of Plainview and the Texas Department of
Health mn cooperation with the Environmental Protection Agency,
intend to construct and develop a Type I, Sanitary Landfill; and
WHEREAS, the City of Plainview agrees to provide sufficient
assets to properly operate and properly close the proposed Type t
Landfill Site and makes a firm commitment to provide back-up
equipment by lease, purchase or diversion from alternatives as
part of the City of Plainview's responsibility.
NOW= THEREFORE, BE IT RESOLVED by the City of Plainview that
James O. Hamm, P.E., has been duly appointed as Consulting and
Designing Engineer, for the purpose of submitting engineering
reports, planning material, plans and specifications for a Type I
Municipal Solid WasTe Landfill. ·
BE IT FURTHER RESOLVED that the City of Piainview declares
its financial responsibility and evidence of competency, and that
the Mayor is authorized to execute any and all documents which
substantiate such.

BE IT FUR~ RESOLVED that William R. Hogge, P.E., Director
of Public Works of the City of Plainview, is designated as the
authorized representative for the City of Ptainview in the
submission and processing of the application for a Type I,
Sanitary Landfill, and is authorized to proceed with said
application to the Texas Department of Health.
BE IT FURTBER RESOLVED that the Mayor, City Manager or
Director of Public Works are hereby authorized to execute any and
all documents required as a part of the apPlication/permitting
processes.
