AN ORDINANCE AMENDING ZONING .ORDINANCE NO. 82-2478
RND.THE OFFICIAL ZONING MAP OF THE CITY OF PLAINVIEW
SO AS TO MAKE THE FOLLOWING CHANGES.
ZONE CASE NO. 555:
Request of Gayle Thompson for rezoning of 1.774 acres of land aut of
the Northeast part of. Survey Na. 34, Block JK-2, .Hale County, Texas,
from an R-1 (Single-Family Residential). Zoning District to a CGB
(Commercial General Business) :Zoning District for commercial uses
and .located at 2103 Dimmtt Road and described as follows:
Being a 1.774 acre (77,293 square foot) tract .out of the Gayle
Thompson tract as recorded in Volume 595, page 177 of the Hale
County. Deed Records out of the .northeast part of Survey No. 34,
Block JK-2, Hale County, Texas:
BEGINNING at a l/2 inch steel rod found 20 feet North of the
northwest corner of Lot 1, Block 5, High School Addition located on
,' ~ the East part of N.E. 1/4 Section 34, Block JK-2, Hale County, Texas,
said rod also being 1,012.3 feet South. and 278.3 feet West of the
northeast corner of said survey;
Thence North along the east right of way line of Smyth street and
its projection, at 111.1 feet pass the southeast corner of Block 6
of said addition, in all 315.5 -feet to a 1/2 inch steel rod found
for an interior corner of said Block 6;
Thence S89°46'E at 15 .feet pass a corner of said block and the
southwest corner of a 0.47 acre tract, in all, 219.5 feet to a 3/8
inch steel rod found in the southwesterly right of way line of State
Highway No. 194 {Dimmitt Road) for the southeast corner of said 0.47
acre tract;
Thence S45°.38'02"E 185.34 feet along said right of way line to a "X"
on concrete for the northeast corner of High School Addition, .Unit
No. 2 as recorded in Volume 696, page 269 of the Hale County Deed
Records;
Thence West 134.9 feet to a 3/8 inch steel rod found for the
\ northwest. corner of said Unit 2;
Thence,.. South 185 feet to a 3/$ inch steel rod found in the north
~~_ line of an alley for the southwest corner of said Unit 2;
Thence West 217.1 feet along the north line of said alley to the
POINT OF BEGINNING and containing 1.774 acres.

WHEREAS, the proposed change in Zoning Districts- as hereinafter
made has. been duly presented to the Planning and Zoning Commission
for its recommendation which was received by the City Council. and
after due consideration, the City Council of the City of Plainview
finds that for the orderly growth of the City making the proposed
change as hereinafter .set out will be in the public .interest which
creates an emergency.; and
WHEREAS, all' conditions precedent required by law for a valid
amendment to the Zoning Ordinance and Map, have been fully complied
with., as well as giving notices provided by Article 1011F Vernon~s
annotated Civil Statutes - Amended, 1953, and notice was .duly
published in the Plainview Daily Herald more than fifteen (15} days
prior to the date of the Public Hearing according to said notice was
duly: held in the City Council room. of the City Hall, Plainview,
Texas, at which time persons appeared in support of the proposal;
and after said hearing, it was by the. City Council determined that
it would be in the public interest due to changed conditions, that
the Zoning Ordinance and the Zoning Map be amended in the manner
hereinafter set forth in the body. of this Ordinance.
NOW,. THEREFORE, BE IT ORDAINED, by the City Council of the .City
of Plainview.:
.SECTION 1. That Ordinance No. 82-2478 and the Official Zoning
Map 'be and the same are hereby amended as follows, to wit:

POINT'OF`BEGIPdNING and containing 1.774 acres.
From the date of. this Ordinance, said .lot, tract-and parcel of land
described ,shall be and hereby be changed to the Zoning District
indicated and the Official Map is amended in accordance herewith.
SECTION 2. A notice that a public hearing shall be held in the
Council Chambers of the City Hall in Plainview, Texas, at 7:30 P.M.
on the 9th day of May, 1989, to permit the public to be heard prior
to consideration of this.Ordinance was published in the Plainview
Daily Herald, a daily newspaper of general circulation in the City
of Plainview,-Texas, said. publication being more than fifteen (15)
days prior to the time designated for said hearing.
Introduced and Public Hearing held on the 9th day of May, 1989.
