ORDINANCE NO. 89-2790
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS, APPROVING A DECREASE IN THE RATES
WHICH MAY BE CHARGED BY SOUTHWESTERN PUBLIC SERVICE
IN THE-CITY OF PLAINVIEW, TEXAS, AND PROVIDING FOR
AN EFFECTIVE DATE FOR SUCH RATES.
WHEREAS, on April 19, 1989, the Public Utility. Commission of
Texas approved an order reducing rates to be charged by Southwestern
Public Service Company in Texas; and
WHEREAS., such rate reduction would reduce rates to be charged in
the City of Plainview; and.
WHEREAS, the City of-Plainview finds that a decrease in rates in
the amount hereafter set forth should be approved.
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the .City
of Plainview, Texas:
SECTION 1. That a decrease in the rates, tariffs and charges of
Southwestern Public Service Company for electric power and energy
sold within the City of Plainview be approved in an amount that as
applied to cities served by the Texas retail 'system would decrease
the annual operating revenues for said company in such cities by
$2,930,000, based on annualized test year usage.
SECTION 2. Southwestern Public Service Company is directed to
file a schedule of Rates and Tariffs under which said Company shall
be authorized to render electric service and tp collect charges from
its customers that will recover rates and charges far the sale of
electric power and energy wi hin the corporate limits of the City of
Plainview that will allow said Company to recover the level of rates
herein established until such time as said Rates and Tariffs might
be changed, modified, amended or withdrawn..
SECTION 3. Southwestern Public Service. Company is .hereby
authorized to place such rates into. effect on June 1, 1989. Said
Company is further directed to calculate the difference between the
rates. in effect an and after June 1, 1989, and the rates in .effect
on July 8, 1988, and refund such difference to current customers
through credits on bills rendered after July 17, 1989.
SECTION 4. That the action of the City of Plainview enacting this
Ordinance constitutes, on its effective date, a final determination
„ of .'rates 'far Southwestern Public Service Company in accordance with
Section 43 of the Public Utility Regulatory Act.
