RESOLUTION R13 -287
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, APPROVING THE REQUEST OF PLAINVIEW / HALE COUNTY
CRIME STOPPERS TO HOST THE "COLOR FUN FREEDOM RUN ";
AUTHORIZING THE FILING OF THE AGREEMENT FOR THE
TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY WITH THE
TEXAS DEPARTMENT OF TRANSPORTATION FOR THIS EVENT;
DECLARING THAT THE EVENT SERVES A PUBLIC PURPOSE; AND
AGREEING TO COMPLY WITH REGULATIONS.
WHEREAS, the Texas Department of Transportation owns and operates S.W. 3rd
Street (FM 3466) in the corporate limits of the City of Plainview; and
WHEREAS, the City of Plainview received a request from the Plainview / Hale
County Crime Stoppers on May 29, 2013 for police assistance in its 5k Color Fun
Freedom Run ( "Freedom Run "); and
WHEREAS, the Freedom Run will follow a route which includes State owned and
operated streets within the corporate limits of the City of Plainview. This event will start
at Running Water Draw Regional Park at 9:00 a.m. and will end at the beginning point.
Attached and incorporated herein to this Resolution is the map depicting in detail the
route to be used; and
WHEREAS, the City Council of the City of Plainview finds that such event serves
a public purpose in that it increases the public awareness of the Plainview / Hale
County Crime Stoppers; and
WHEREAS, the City Council of the City of Plainview, Texas finds it in the best
interest for the citizens of Plainview that the Plainview / Hale County Crime Stoppers
"Color Fun Freedom Run" be held this year on Saturday, July 6, 2013 and use the
above referenced route; and
WHEREAS, the Texas Department of Transportation requires the Local
Government to submit a completed Agreement for the Temporary Closure of State
Right -of -Way for use of FM Road 3466 (SW 3rd Street) in such public events as this 5k
Run; and
WHEREAS, the City Council designates Mayor Wendell Dunlap as the City's
authorized official. The authorized official is given the power to apply for or terminate
such Agreement on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Plainview that:

I.
The request from the Plainview / Hale County Crime Stoppers to host the "Color
Fun Freedom Run" for July 6, 2013 is hereby approved.
II.
The public purpose of this event is to increase the public awareness of the
Plainview / Hale County Crime Stoppers program.
III
Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE
OF STATE RIGHT -OF -WAY with the Texas Department of Transportation is hereby
approved.
IV.
The Mayor is hereby authorized and directed to execute, respectively, on behalf
of the City of Plainview, all necessary documents, including the AGREEMENT FOR
THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY to complete the Plainview /
Hale County Crime Stoppers "Color Fun Freedom Run" preparation process.
PASSED and APPROVED this 25 day of June, 2013.
