ORDINANCE NO. 89-2795 AN ORDINANCE DESIGNATING A PARKING LOT LOCATED AT 2801 OLTON ROAD, PLAINVIEW, TEXAS, AS A .PUBLIC PLACE DURING CERTAIN .TIMES; SETTING A MAXIMUM SPEED LIMIT THEREIN DURING SUCH TIMES AS SET FORTH; AUTHORIZING THE DIRECTOR OF PUBLIC SAFETY TO REGULATE. THE OPERATION AND PARKING OF VEHICLES AT SUCH LQCATION DURING CERTAIN TIMES; PROVIDING FOR A PENALTY; AND OTHER RELATED PROVISIONS. WHEREAS, the .City. of Plainview has acquired a leasehold interest in property located at 2801 Olton Road, Plainview, Hale County, Texas for the purpose of establishing a lawful public gathering place during certain times and under certain condtions as set forth herein; and WHEREAS, an engineering and traffic investigation study has been conducted in regard to the :vehicular movement of traffic within said public place; and. WHEREAS, said engineering and traffic investigation has determined that it would be in .the best interest of the City. of Plainview and the safety of the citizens of Plainview that a '`' certain speed-limit be designated for the vehicles traveling `--°' therein during certain specified hours; and WHEREAS, certain other regulations regarding. the operation and parking of vehicles at 2801 Olton Road, Plainview, Hale County, Texas during .certain specified hours .should also be prescribed. NOW, THEREFORE, $E IT ORDAINED BY THE'CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS that:. ..Section 1: That between the hours of 8:00 p.m. to 12:00 a.m. on Friday's .and Saturday's of each week, the. following location is hereby designated a public place under the terms and conditions as set forth herein: 2801 Olton Road, Plainview:, Hale County, Texas or more properly described as College Hi11 Addition, Plainview, Block $6, 36' x 752', herein referred to as "The Box Parking Lot". Section 2: It shall be unlawful for any person to drive a vehicle upon. the Box Parking Lot at a-speed that is greater than is reasonable and prudent under the circumstances than existing, and .the speed limit specified in this ordinance shall be the lawful speed limit, and any speed in excess of the limits of 1 of 3 specified and authorized by law shall be prima facia evidence that the speed is not reasonable ar prudent and that it is unlawful. Section 3: Upan the basis of an engineering and traffic investigation study heretofore made, the prima facia speed limit of 10 miles per hour is determined and declared to be .the .prima facia reasonable and prudent speed limit upon the Box Parking Lot, and the rate of 10 miles per .hour is hereby fixed as the speed- limit for vehicles traveling upon the Box Parking Lot between the hours of 8:00 p.m. each Friday until 12:00 a.m. each Saturday next following and between the .hours of 8:00 p.m. to 12:00 a.m. each Sunday next following, continuing for as long as said parking lot is leased to the City of Plainview pursuant to Resolution R8:9-160. Section 4: The Director of Public Safety or_hs designee, .except. as otherwise directed from time to time by the City Council, shall have the power and is hereby authorized to regulate the operation and parking of vehicles within the Box Parking Lot during the times such parking. lot is used as a public place. Such authority shall include the power to erect or place proper signs, ..markers ,. lights, or other devices indicated >prohibting or limiting:.parking, restricting speed areas, one-way traffic, restrictions or limitations on vehicular traffic, .through or arterial rights-of-way, stop signs, "U"-turns, and other' signs or markers indicating the place and manner of operating ar parking vehicles. Section: 5: Any person violating any of the provisions of this ordinance shall, upon conviction thereof be fined a sum of not less than ten dollars {$10.00) .nor more .than five hundred .dollars ($500.00). Section 6: Should any word, phrase, section, provision, or clause of this ordinance be deemed void or invalid .for.. any reason,- the remaining provisions of this ordinance shall be unaffected.
