RESOLUTION NO. R13 -291
A RESOLUTION OF THE CITY OF PLAINVIEW CALLING AND SETTING
THE DATE FOR THE SPECIAL MUNICIPAL ELECTION; DESIGNATING
THE ELECTION OF A COUNCILMEMBER FOR DISTRICT 5;
DESIGNATING THE DISTRICT AND POLLING PLACE FOR DISTRICT
5; DESIGNATING EARLY VOTING DATES AND SETTING TWO
TWELVE HOUR DAYS FOR EARLY VOTING AS REQUIRED BY
SECTION 85.005 (D) OF THE TEXAS ELECTION CODE; AND POSTING
NOTICE OF ELECTION.
WHEREAS, in accordance with the statutes of the State of Texas and the
Charter of the City of Plainview, a special election shall be held in and for the City of
Plainview; and
WHEREAS, the election shall be held on the first Tuesday in November, 2013,
the same being November 5, 2013; and
WHEREAS, said special election is to fill the vacancy left in District 5 by the
resignation of Shane Martinez submitted on August 1, 2013; and
WHEREAS, Section 85.005 (d) of the Texas Election Code states that in an
election ordered by a city, early voting by personal appearance at the main early voting
polling place shall be conducted for at least 12 hours: (1) on one weekday, if the early
voting period consists of Tess than six weekdays; or (2) on two weekdays, if the early
voting period consists of six or more weekdays; and
WHEREAS, all persons qualified to vote in said election under the Election Laws
of the State of Texas shall be allowed to vote therein.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Plainview that:
SECTION 1
A special election shall be held in the City of Plainview, Texas on the 5 day of
November, 2013. Said election is to elect a Councilmember for District 5 to complete
the unexpired term of Councilmember Shane Martinez who resigned on August 1, 2013.
SECTION 2
All electors shall vote in the voting district in which said voter resides, and at the
polling place provided for voting as designated in Section 3 of this Resolutioi.

SECTION 3
The election shall be held in the designated district within the City, at the
designated polling place within the district as designated below:

Early voting by personal appearance will be conducted each weekday at 901
Broadway, Plainview, Texas between the hours of 8:00 a.m. and 5:00 p.m. beginning on
October 21, 2013 and ending on November 1, 2013. On October 21, 2013 and October
28, 2013 early voting by personal appearance will be conducted between the hours of
7:00 a.m. and 7:00 p.m. as required by Section 85.005 (d) of the Texas Election Code.
SECTION 5
Notice of this election shall be given in accordance with the provisions of the
Texas Election Code and returns of such notice shall be made as provided for in said
Code.
