R13 -299 A RESOLUTION OF THE CITY OF PLAINVIEW CALLING AND SETTING THE DATE FOR THE RUNOFF MUNICIPAL ELECTION; DESIGNATING THE ELECTION OF A COUNCILMEMBER FOR DISTRICT 5; DESIGNATING THE DISTRICT AND POLLING PLACE FOR DISTRICT 5; DESIGNATING EARLY VOTING DATES AND SETTING TWO TWELVE HOUR DAYS FOR EARLY VOTING AS REQUIRED BY SECTION 85.005 (D) OF THE TEXAS ELECTION CODE; DESIGNATING THE EARLY VOTING BALLOT BOARD JUDGE; DESIGNATING THE DISTRICT POLLING PLACE JUDGE; SETTING HOURLY RATE FOR ELECTION OFFICIALS AND POSTING NOTICE OF ELECTION. WHEREAS, a special election was held on November 5, 2013, the City Council having canvassed the returns of the Special Election and having determined that no candidate for the office of Councilmember District 5 received a majority of the votes cast for the office and that Becky Summers received the highest number of votes and Susan Zeigler Blackerby received the second highest number of votes cast for Councilmember District 5; and WHEREAS, in accordance with the statutes of the State of Texas and the Charter of the City of Plainview, a runoff election shall be held in and for the City of Plainview; and WHEREAS, the runoff election shall be held on December 19, 2013; and WHEREAS, said runoff election is to fill the vacancy left in District 5 by the resignation of Shane Martinez submitted on August 1, 2013; and WHEREAS, Section 85.005 (d) of the Texas Election Code states that in an election ordered by a city, early voting by personal appearance at the main early voting polling place shall be conducted for at least 12 hours: (1) on one weekday, if the early voting period consists of less than six weekdays; or (2) on two weekdays, if the early voting period consists of six or more weekdays; and WHEREAS, all persons qualified to vote in said election under the Election Laws of the State of Texas shall be allowed to vote therein. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview that: SECTION 1 A runoff election shall be held in the City of Plainview, Texas on the 19 day of December, 2013. Said runoff election is to elect a Councilmember for District 5 to complete the unexpired term of Councilmember Shane Martinez who resigned on Resolution R13 -299 Runoff Election Page 1 of 3 August 1, 2013. SECTION 2 All electors shall vote in the voting district in which said voter resides, and at the polling place provided for voting as designated in Section 3 of this Resolution. SECTION 3 The runoff election shall be held in the designated district within the City, at the designated polling place within the district as designated below: SECTION 4 Early voting by personal appearance will be conducted each weekday at 901 Broadway, Plainview, Texas between the hours of 8:00 a.m. and 5:00 p.m. beginning on December 2, 2013 and ending on December 13, 2013. On December 3, 2013 and December 10, 2013 early voting by personal appearance will be conducted between the hours of 7:00 a.m. and 7:00 p.m. as required by Section 85.005 (d) of the Texas Election Code. SECTION 5 Said special election shall have as its Early Voting Ballot Board presiding election judge, Georgia Wall. On December 19, 2013, the District 5 Polling Place Judge will also be Georgia Wall. SECTION 6 CITY DISTRICT NO. 5 Voting Place: Edgemere Elementary School 2600 West 20 Street Plainview, Texas It is further provided that the hourly rate for presiding election judges shall not exceed $10.00 per hour, and the hourly rate for Clerks shall not exceed $8.00 per hour. SECTION 7 A copy of this resolution shall also be served upon the election officials designated to hold the election. Resolution R13 -299 Runoff Election Page 2 of 3 107 108 SECTION 8 Notice of this election shall be given in accordance with the provisions of the Texas Election Code and returns of such notice shall be made as provided for in said Code.
