HomeMy WebLinkAbout90-2821INDEPENDENCE STREET - PROHIBITING PARKING, STOPPING OR STANDING ORDINANCE NO. 90-2821 AN ORDINANCE PROHIBITING THE PARKING, STOPPING OR STANDING OF ANY MOTOR VEHICLE DURING CERTAIN TIMES ON A PORTION OF INDEPENDENCE STREET, PLAINVIEW, TEXAS, PROVIDING A PENALTY; PROVIDING FOR CONFLICTS; PROVIDING FOR AN EFFECTIVE DATE; AND AUTHORIZING THE CITY SECRETARY TO PUBLISH PURSUANT TO LAW. WHEREAS, the Parent Teacher's Association (PTA) and staff of Lakeside Elementary School have requested that the City Council of the City of Plainview address the traffic problems around the school during certain hours of the day; and WHEREAS, members of the Plainview Police Department have met with the PTA and staff of Lakeside to'discuss the validity of this request; and WHEREAS, a traffic and engineering study has been conducted which indicates the parking of vehicles on the East side of the portion of Independence Street between 18th Street and 20th Street during certain hours is creating a hazardous situation for persons and property; and WHEREAS, the City of Plainview views the traffic problems as an urgent concern; and WHEREAS, the City Council of the City of Plainview, Texas, has determined that it would be in the best interest of the public that parking, stopping or standing of motor vehicles of any kind be prohibited on the following portion of Independence Street, City of Plainview, Texas between the time frames of 7:00 A.M. - 8:30 A.M. and 3:00 P.M. - 4:30 P.M., Monday through Friday, to wit: From 18th Street Independence Street. to 20th Street on the East side of NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview, Texas: Section 1: Parking, stopping or standing of any kind of motor vehicle on the East side of the portion of Independence Street from its intersection with 18th Street to its intersection with 20th Street between the time frames of 7:00 A.M. - 8:30 A.M. and 3:00 P.M. - 4:30 P.M., Monday through Friday, is prohibited. Section 2: Ail Ordinances or portions of any Ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. 1 of 2 Section 3: Any person who shall violate or fail to comply with any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine as set forth in Section 1-5, Plainview City Code, pursuant to law. Section 4: This Ordinance shall be of full force and effect upon its passage and publication as required by law. Section 5: The City Secretary is hereby authorized, pursuant to Local Gov't Code ~52.013 (Vernon 1990) to publish only the caption and penalty provisions of this Ordinance.
