HomeMy WebLinkAbout90-2825HEALTH DEPARTMENT - STAGGERED PERMITTING ORDINANCE NO. 90-2825 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS AMENDING SECTION 11-37, ARTICLE III, CHAPTER 11 OF 'THE PLAINVIEW CITY CODE ALLOWING THE STAGGERED PERMITTING OF FOOD SERVI CE ESTABLIS}~NTS, RETAIL FOOD STORE ESTABLISH~%VfS; AND PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR CONFLICTS; AND PROVIDING FOR A SEVERABILITY CLAUSE. WHEREAS, Ordinance No. 78-2211, 85-2623 and 86-2681 have provided for various terms and conditions regarding the issuance of annual permits for food service establishments or retail food stores; and WHEREAS, the foregoing Ordinances have been Codified into Article III, Chapter 11 of the Plainview City Code; and WHEreAS, Section 11-37 provides for the annual permitting of food service establishments or retail food stores at the beginning of each calendar year; and WHEREAS, the annual permitting at the beginning of each year as provided for in Section 11-37 has created an administrative burden and encumbered the efficiency of the Health Department operations; and WHEREAS, the food service establishments and retail food stores would be better served by allowing the permitting of said establishments on a staggered basis throughout the calendar year; and WHEREAS, the City Council of the City of Plainview finds it to be in the best interests of the City of Plainview to stagger the permitting dates of food service establishments and retail food stores. NOW, THEREFORe, BE IT ORDAINED by the City Council of the City of Plainview that: Section 1: Section 11-37, of Article III, Chapter tl of the Plainview City Code be amended to read as follows: a. The annual permit fee for a food 1 of 3 service establishment or retail food store establishment shall be seventy-five dollars ($75). b. The annual permit fee for food sellers shall be fifty dollars ($50.00). A seasonal permit, for those food sellers in operation three (3) months to two (2) weeks shall be twenty-five dollars ($25.00). The permit fee for those food sellers who are temporary, that being in operation for two weeks or less out of the calendar year, shall be fifteen dollars ($15.00). c. The permit fee for those establishments which are seasonal, that being in operation from three (3) months to two (2) weeks out of the calendar year, shall be thirty dollars ($30). d. The permit fee for those establishments which are temporary, that being in operation for two weeks or less out of the calendar year, shall be fifteen dollars ($15). e. The above fees and schedules are subject to change as the Plainview-Hale County Health District deems necessary. Any permit or fee change may occur by a written administrative policy declaration. Fee schedules and permitting policies shall be reviewed on annual basis by the Plainview-Hale County Health District and the City Manager's Office shall be advised of the findings of the review as well as any Changes in the fee structure, policies or rates. Section 2: Severabilit¥. If any provisions of this ordinance or of the Code hereby amended or the application thereof to any person or circumstances held invalid, the remainder of the Code and the application of such provisions to other persons or circumstances, shall not be affected hereby. Section 3: Conflicts. If any of the provisions of this ordinance or of the Code hereby amended or the application thereof to any person or circumstance is in conflict with another provision or ordinance, the provisions set forth in this ordinance shall prevail. 2 of 3 Section 4- Effective Date.
