CODE - 1990 NATIONAL ELECTRICAL CODE ORDINANCE NO. 90-2832 A ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, ADOPTING THE 1990 EDITION OF THE NATIONAL ELECTRICAL CODE (NFPA 70-1990) AND REPEALING ALL PREVIOUS EDITIONS OF THE NATIONAL ELECTRICAL CODE HERETOFORE ADOPTED; PROVIDING A SEVERABILITY CLAUSE; DIRECTING PUBLICATION OF THE DESCRIPTIVE CAPTION TOGETHER WITH PENALTY PROVISIONS OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Board of Electrical Examiners of the City of Plainview has heretofore approved and recommended revisions to the local Electrical Code and the City Council has heretofore adopted such revisions in Ordinance No. 84-2550; and WHEREAS, the Board of Electrical Examiners of the City of Plainview has approved the recommended adoption of the 1990 Edition of the National Electrical Code (NFPA 70-1990) to the City Council, as revision and updating of Electrical Codes is necessary and essential for the protection of the public health, safety and property and in the best interest of'the citizens of Plainview, Texas. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview: SECTION 1. That Section 6.1 of the Electrical Code of the City of Plainview (Ordinance No. 84-2550) be amended to read as follows to wit: "National Electrical Code shall mean the 1990 Edition of the National Electrical Code (NFPA 70-1990) as adopted by the National Fire Protection Association." SECTION 2. PENALTIES: Any person, either by himself or by agent, and any firm, corporation or other entity who violates any other provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction of any such violation, shall be fined in any sum not to exceed ONE THOUSAND DOLLARS ($1,000); and each day during which such violation continues shall constitute a separate and distinct offense. In any case of a violation of any of the terms or provisions of this Ordinance by any corporation, the officers and agents actively in charge of the business of such corporation shall be subject to the penalty herein provided. Any offense defined herein which has been defined by the law of the State of Texas as an offense and for which a penalty has been prescribed shall be punished as provided in said State law and nothing herein shall be held as fixing any penalty contrary to a penalty provided by the laws of the State of Texas. 1 of 2 SECTION 3. SEVERABILITY CLAUSE: If any provisions of this Ordinance hereby adopted or the application thereof to any person or circumstance is held invalid, the remainder of the Code, and the application of such provisions to other persons or circumstances, shall not be affected thereby. SECTION 4. REPEALER CLAUSE: Ail other Ordinances or parts of Ordinances inconsistent with or conflicting with the terms hereof are hereby repealed. SECTION 5. PUBLICATION: The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provisions for the violation thereof. This Ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law. Passed and Approved this 12th day of June, 1990. E.V. The descriptive caption and penalties of said Ordinance are as follows: A ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, ADOPTING THE 1990 EDITION OF THE NATIONAL ELECTRICAL CODE (NFPA 70-1990) AND REPEALING ALL PREVIOUS EDITIONS OF THE NATIONAL ELECTRICAL CODE HERETOFORE ADOPTED; PROVIDING A SEVERABILITY CLAUSE; DIRECTING PUBLICATION OF THE DESCRIPTIVE CAPTION TOGETHER WITH PENALTY PROVISIONS OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. PENALTIES The penalties for the violation of said Ordinance are as follows: SECTION 2. PENALTIES: Any person, either by himself or by agent, and any firm, corporation or other entity who violates any other provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction of any such violation, shall be fined in any sum not to exceed ONE THOUSAND DOLLARS ($1,000); and each day during which such violation continues shall constitute a separate and distinct offense. In any case of a violation of any of the terms or provisions of this Ordinance by any corporation, the officers and agents actively in charge of the business of such corporation shall be subject to the penalty herein provided. Any offense defined herein which has been defined by the law of the State of Texas as an offense and for which a penalty has been prescribed shall be punished as provided in said State law and nothing herein shall be held as fixing any penalty contrary to a penalty provided by the laws of the State of Texas.
